              Hi,
              i believe I was there about 2hours 30/40 mins and would have likely paid for a 2 hour ticket, but it took my partner about 40 mins to get to me with money. Problem is, I'm not certain on times etc and because I didn't receive the the first three letters from PE giving details, I can't confirm this.

                Yes, it's the car park that the hotel guests can park in. Unfortunately, it doesn't belong to the hotel but to PE

                  This is beginning to smell to me as a place I go have a parking company i belive it could be parking eye doing there car park and they say that they can't cancel a ticket

                  if they do own it would they have to pay rates to poole council ??

                    I would even be willing to pay the initial £60 charge (despite the fact that I don't believe this amount equates to the 40mins over stay). I just didn't get the chance.

                      If you offer to settle with them they'll usually accept particularly if you want to pay £60. I'd try negotiation and aim for £50 tops if you wish to settle.

                      Let me know if you're settling or want me to draft a defence. I'd fight especially as the Beavis appeal is likely to do the hard work for you but if court is too scary then settle if possible. You have to do what you believe is correct for yourself.

                        Hi M1,
                        thank you again for taking the time to reply. When I spoke to PE on the day I received my court letter, they said they would drop the charge to £125 but no less as it had already gone to court. Can you tell me what the Beavis appeal is and how it would help me. I really cannot afford to pay but the thought for going to court terrifies me. Would I have to go to the court itself? I am full of questions!
                        The whole situation makes me cross. Do you think I stand any chance of winning? I guess I'm doubtful because in reality I was in the wrong for not paying for the first 40 mins.

                          Although my engine was not turned off and I did not leave the vicinity of the vehicle until my partner arrived with money for a ticket. Therefore I believe I was not parked

                            Beavis is a case which was lost at the low level court but the "maverick" judge used his imaginative understanding of the law in such a way even he decided it was deserving of a more learned set of people to really decide. The appeal takes place at the end of February. If the court of appeal decides in favour of Beavis (the motorist) then it is binding on the lower courts.

                            There is a scenario where you may never see the inside of a court and win. This would be to enter a defence, ask the court to stay pending the appeal result and if it goes our way your case is dismissed because penalties can't be commercially justified nor even allowed at all under English law.



                            Now in your specific case you may have a further argument that you were deciding whether to park when awaiting your partner. Whether a court would buy that depends on your judge.
