    Beavis lost but is going to the supreme court.

    At present your case is stayed so do nothing unless you hear anything. Ideally it'll be stayed pending the supreme court ruling which could be ages away.

        my case was adjourned to 25 July 2015 due to the beavis is case. I have not heard anything from parking eye or the court. Do I have to send all the paperwork again to parking eye and the court again within 14 days of case?

        I know you said it is stayed until the the Supreme Court but I have not been given any paperwork from court or PE.

          You should not have to send anything previously sent.

          I would contact the court and point out the above case is being heard 21st July for 3 days and is likely to be a reserved judgement and that the stay until 25th will need extended.

          Quick phone call should suffice.

              I spoke to the court and they told me to put it in writing to the judge that I wanted an extension on the stay.

                      PE are saying on their witness statement no order was given by court to justify a stay/extension.
                      i am confused in what to put into email/letter.

                        Dear Court manager,

                        In the case of Parking Eye v xxxxx

                        I would ask that as the claimant has sent a reply to defence which extensively points to ParkingEye v Beavis that the court utilises it's case management powers and makes a case management decision of it's own volition to stay the above case pending the decision of the supreme court. There are currently at least 3 court orders to the same effect. 29 April 2015 Kingston upon Thames ParkingEye v Mr B A7FC835N &Aberystwyth Court, case no 3JD08308 ParkingEye v Davies







                        This case has previously been stayed having been in court at which time the claimants representative suggested we await the ruling in Parkingeye v Beavis. That appeal starts in the supreme court on 21/7/15 and is due to last 3 days at which time it is expected judgement will be reserved.

                        Parking penalty charge appeal


                        Barry Beavis (Appellant) v ParkingEye Ltd (Respondent)


                        9 June 2015


                        On 23 April 2015, the Court of Appeal granted Mr Beavis permission to appeal its judgment on the recoverability of penalty charges imposed by a private car park operator upon those who overstay a limited period of free parking.

                        The Supreme Court will now hear Mr Beavis' appeal alongside that of Cavendish Square Holding BV v Talal El Makdessi, which also involves the enforceability of penalty clauses in contracts. You can find more details about this case here:

                        The hearing of the two appeals will begin on Tuesday 21 July 2015.


                        Judgment is highly likely to be reserved and delivered at a later date, which will be published on this website in the usual way.

                        They are saying that although Beavis was appealed the judgements so far have not be set aside and are still live which is them trying to confuse.

                            i received a reply from the court. They are asking me to fill in a N244 form to request a stay. Which will cost £155.

                                No. It's too late really and at £155 not worth it.

                                Turn up on time and ask again when you are in front of the judge.

                                If this fails make sure you are ready. Plenty good reading http://parking-prankster.blogspot.co...arguments.html and i certainly wouldn't pretend i knew better than 2 QCs so well worth reading in preparation.
