    Went to the clinic. They say they lease the property and the parking area is private land. They are saying to pursue with parking eye. All they can provide is an appointment letter, which I already got from them.
    How do I pursue my case now?.
    also
    does the court provide separate paperwork for allocation, as I did not get this in the paperwork stating that parking eye have rejected my defence.

      Allocation comes from the court.

      Parking eye can't reject your defence. They can argue your legal arguments are wrong but it's the judge who decides not them.

      It's a shame the clinic are washing their hands of it.

        The clinic says that everyone that shows that they have an appointment gets Their ticket cancelled. I did not mention that in my defence. Can I still bring this up in court?

          In addition,
          the people who appealed to P.E before court got tickets cancelled, but they could not advise on the outcome on people going to court.

            It could depend on what's in the contract. Other than that it won't matter much.

              by the looks of other threads that i have read there is no chance that i'll get a look at the contract.
              how does the court get allocated, as i have not recieved any more paperwork other then P.E reason to refuse my defence. i have posted all the paper work that i have recieved.

                Well now that ParkingEye v Somerfield and the Cambridge case the claimant will have grave difficulties without a contract.

                Also given cpr 1.1 along with Mitchell etc http://civillitigationbrief.wordpres...ll-case-watch/ it would be very much in your interest if the court orders production of a contract and they do not comply.

                      Hi mystery1.
                      i have been given a court date which is due very soon. I have been on the forum fo some time due to family problems.
                      I have to file a defence which has to reach the court and parking eye 14 days before the case.
                      i need help regarding how to proceed with my defence. Any pointers on how I can present my defence, also do I mention my mothers appointments or do I just stick to the defence that I gave. Also parking eye's defence was heavily quoting the Cambridge case and hhj maloneys comments. The defence is already posted to previous threads above.

                          Then log on to the mcol site and go through the stage to enter the defence but instead of the defence put emailed to
                          ccbcdefendants@hmcts.gsi.gov.uk on 16/05/14. (for safety reasons really)

                          All that is required is a witness statement and a skeleton argument (not required but advised)

                            my case hearing is on 31-10-14. i have only a few days left to give in the defence and evidence, as the court letter states that both the court and the claiment have to have the paperwork 14 days beforehand. (i know its all last minute but i have had bereavement in the family and my mind was occupied on the loss).
                            mystery1, have i not already filled this and the attachment in?on page 1 on the 16-5-14?
                            also
                            for the witness statement do i just put down the reason why i was in the car park (taking my mother to her doctors appointment) and would the fact the receptionist told my wife to come upstairs for my mums appointment and not bother queing at the downstairs reception (which has the keypad to put in her car reg in) be the skeleton argument?
                            i did not ask for a stay pending beavis.
                            can i speak for my wife in court as she is very nervous and does not speak very good english.

                                the case has been allocated, and the hearing date is on the 31-10-14. i have to give all documents on which i will rely on to parking eye and the court fourteen days prior to the hearing.
