  • Met parking lease car

Hi, I to have received a parking charge notice but my question is slightly different to others unless I haven't found the right thread.

Basically the driver parked at the Starbucks in stansted airport and i have only just received the notice reminder on 2 months later, I have contacted Starbucks to dispute this and told them the driver was a paying customer and that they have proof of purchase, I'm currently waiting a response from the manager at the customer care team.

So my question is this, do Met Parking Services have a set period of time that they must notify you of the parking charge? I know if you are caught speeding via a camera they have 14 days to inform you?

It's been two months since the "date of incident", the car is a lease car and the lease company released my details to Met Parking Services, which they do for all tickets so the owner of the vehicle can challenge if necessary.

    Any feedback is greatly appreciated.

Re: Parking Charge Help Please!! MET parking

As this was a hire car they have an extended period of time to contact you to allow for the original contact with the hire company. They had 14 days to contact the hire company. There is a limit but I can't remember it off hand. Did the letter that you received from Met also contain a copy of your details from the rental agreement? If it is not there then Met have failed to follow the procedures of POFA that would have allowed them to claim the parking charge fee from the keeper, they can only claim from the driver, who they do not know. Modify your post, or start your own thread, so that the identity of the driver cannot be inferred.

The legislation that they are trying to follow, POFA, is here. You will be looking at paragraph 9, 13 & 14. Appeal, without naming or identyfing the driver, and get a POPLA code (if they are are members of the BPA) and a most probable win at a POPLA appeal.

Edit: Max of 49 days from incident to receipt of notice to hirer/keeper.

      Dear Sirs,

I, as the hirer/keeper, wish to invoke your appeals procedure. The driver was a genuine customer.

I note you have failed to follow POFA 2012 schedule 4 and as such only the driver can be held responsible.

Should you reject my appeal please supply a popla code.

      Yours etc

      M1

        Re: Met parking lease car

Hi thank you very much for the updates.

It's been 57 days since the incident and that is the first notification I received, basically two letters in the one day stating the same info that it is overdue etc but no mention of why they were requesting I pay £100 just a reminder it's overdue, the hire/lease company failed to pass on the first letter which had a picture of the car going in and leaving the car park outside of the permitted time, the hire/lease company have subsequently forwarded this on to me via an email.

So all in all the first notification I have had of this incident was last week?

Not sure whether to just ignore this letter or not, I see you edited to 49 days, is that the length of time they have to notify me directly?

          Re: Met parking lease car

The details are all in the link to the POFA details that I added. I may have got it wrong, I suggest you make your calculations. With no windscreen ticket the PPC have up to 14 days to contact the hire company. The hire company then have up to 28 days to reply to the PPC. The PPC then have up to 21 days to contact the hirer. Adding that up makes a grand total of a max total of 63 days after the event, so I did get it wrong. The actual times depend on the timings of the letters.

The lease company do not have to send everything to you, they only have to respond to the PPC within the relevant period, you don't know that actual time. You should have received your very own Notice to Keeper/Hirer from the PPC. So what did you actually receive from the PPC? It is that letter that you, as the KEEPER, will be responding to.

As you go further into this you will realise that the camera entry and exit times are not the period of parking that is required by POFA. Can you confirm if you received your hire details included with your letter from MET ? POFA paragraph 14 2 (a) requirement.
