  • POPLA Appeal

    Hi,

    In the summer I parked my vehicke at a Premier Park car park. There was a lengthy queue and only one machine working. My son stayed in the queue whilst I went to let our appointment know we had arrived and my son would be with us shortly. We decided in fact to defer the meeting so I returned to the car park expecting to meet my son on the way only to find him still in the queue. I told him that the appointment had been deferred and as we had a lot to do that day we could not queue any longer for the ticket and in any case we no longer needed one. So we left. I was very surprised to receive a penalty notice but assumed that when I explained what had happened, the company would be able to check and indeed confirm that there was a problem on that day with their machine and that would be the end of it. But, no they suggested that I should have remained in the queue to purchase a ticket I no longer needed or make a call to RINGO.

    I have appealed and POPLA have refused the appeal also saying that I should have called RINGO and paid in that way. They have ignored the fact that I left my son queuing for the ticket and implied that I left the car park without paying.

    POPLA had also advised that my appeal would be determined on or around 12th August but they only wrote to me on 12th September. I have gone back to them as I maintain that they have not addressed all of the points that I have raised in my appeal and am yet to have a response from them. In the meantime I have today received a letter from Premier Park demanding I now pay up £100 or risk court action.

    I have sent Premier Park an email advising that as far as I am concerned the appeal is ongoing.

    Just wondering what my next step should be?

    Any advise would be much appreciated.

    You would have won at popla with a good appeal but never on mitigation as you have found to your cost.

    Sadly it's either pay or ignore and see if they take you to court. I'd do the later and keep an eye on Beavis at the supreme court because if he wins they are very unlikely to try court. Conversely if he loses expect all the bottom feeders to have a part at courts up and down the land.

          Thanks, to be honest I am livid at the injustice of this, we joined a queue in good faith to pay to park, when it became clear that the queue was taking an inordinate time to subside, and needing to be elsewhere we left. It never occurred to me to use RINGO and in any case I could not have done so as I had no cards on me at the time. We left without even thinking this would be the result It came as a complete shock when we received the letter and I honestly believed that the explanation could be validated by the company from their records of activity at the car park and the machines that day. It seems that they don't even have to properly investigate. I am minded to have my day in court, even though this is causing me sleepless nights and much stress,

            As your appeals options no longer exist then it's either pay or wait for them to try court, sadly. Just file everything and respond to a letter before action or court papers.
