  • I'd like to say Hi and ask for advice about a fine from a private parking company

    I received a parking ticket from Premier Park back in September 2014. Friends and work colleagues told me it wasn't enforceable and to ignore it, which I did. Then received increased charge notice from Premier Park and then from Debt Recovery Plus Ltd and Zenith Collections threatening court action if I didn't pay £150. Have also received offers of reduced payment to £120 and now £99.99 if I pay within 7 days. I was going to pay it today but then I heard about the court case next week and the possibility that these charges are illegal and that people may get refunds for parking penalties paid and thought I would re-think.

    So please could someone advise me whether I'm to late to challenge this and in light of recent news should I pay or should I hold firm and resist the PCN.

      There'll be good advice coming from other members, but do inform your friends and colleagues that ignoring private parking invoices (they are not fines!) is not the correct advice any more.

        Can you post up any letters/notices you have and pictures of signage you may have ? (no names etc but leave the dates in)

          Many thanks for that. I have attached the most recent letter and would really appreciate your advice on this. Part of me wants to challenge this but another part thinks I've left it too late and should pay it.

            The original 1/2 notices would help tremendously.

            Or if you are confident yourself, we need to know if they are chasing the registered keeper or driver, if the driver how they know this or if the RK have they complied with http://www.legislation.gov.uk/ukpga/...dule/4/enacted

              Thank you Mystery1 for the prompt response.

              I've attached the first 2 letters from Premier Park. I was both the driver and the registered keeper. I looked at the link you included in your response and it seems quite complex and all in legal jargon, could you summarise its meaning and potential impact?

              Really appreciate your advice and help.

                I would say they have failed to comply with the keeper liability regulations. However it's one of those greyish arguments and in any event you admit to being the driver so they really don't need to utilise keeper liability.

                They are not aggressive when it comes to litigation so i'd shove all letters in a drawer and ignore anything that is not a court claim or letter before court claim.

                If Beavis wins it's unlikely you'll ever go to court. If Beavis loses i expect all manor of cockroaches to go to court.
