yes, it was struck out, so i thought that was that, so now im confused as to why its still going ahead, they've paid to persue this case, and i cant figure out how much were likely to pay if they win???Comment

1. Contact the court and ask when and why the case was reinstated after it was struck out.
2. Very important - When and how were they informed that you were driving ? (proof ?)

I've phoned the courts and I can go in his place and give his defence, I asked about the stay and they are saying that they have no record of it, I know my defence is utter crap, but this is totally alien to me, wish I found you guys a long time ago!!Comment

You can represent him but only if he is there in person.
It wasn't a stay i'm wondering about. A stay is a suspension. It was struck out which means game over.
On option we do have is to request a stay until the Beavis case is over at the supreme court but the question i want an answer to is when did parking eye get the drivers details (save for the fact they deny receipt) because Beavis has little relevance if the keeper has no liability anyway.

Yes sorry I ment struck out, they say there's no record of this, they got his details from the dvla as standard, I phoned them in January and this was when I told them it was me driving, but they've not acknowledged the phone call in their defence, they are still pursuing my ex for this, he's just worried that if they win he will have a ccj against him and he has to renew his mortgage next year!!!!Comment

We need to be quick here because your defence will fail 100% of the time. We need to amend it somehow whetehr that is with an application or a request for a stay pending Beavis.
The only other option is to phone ParkingEye and negotiate a lesser payment.
