PCN wrong address and bailiffs warrant of execution

    Ok thank you wales01man.

    So if I write to the council for a Cessation of Enforcement due to non-compliance with part 75.7 of civil procedure rules, they may stop for now but then re-issue another warrent under the right address and the whole thing will start again.

    Essentially I have already paid £120 to Collect Services (wrong thing to do I know now) and I know the council will not see any of that money so in their eyes I haven't paid and they still want their money. Is there a way of retrieving that £120 from Collect Services (still waiting to hear if Bailiff is registered) to pay to the council direct OR because I didn't receive all the paperwork at the beginning and because the machine was broken any way is there a way I can get the PCN voided completely?

      Hi everyone,

      Sorry for the late reply I have only just received an email reply from the council this morning even though I emailed them a month ago.

      I also emailed and posted (with proof of postage) Collect Services to ask them for a breakdown of their fees. This was on the 19th and 20th of March. I have still had no response from them.

      I stated this in the email to the council and received this reply to that point -

      7 – You are awaiting information from Collect Services Ltd confirming whether or
      not their bailiff is registered and a breakdown of their charges.
      I have contacted CSL and they have confirmed that they have not received any written
      communication from you. I have however enclosed with this letter a breakdown of the
      charges which has been supplied to us by CSL. Please see appendix 3.

      I have attached the copy of fees that the council received from Collect Services.
      My issues are -

      1. No reply was made to me via email or post from Collect in regards to the fees breakdown request. Am I right in thinking they are unable to pursue their money until this is supplied?

      2. Collect Services say they did not receive the letter although I have proof of postage to the address on their letter plus an email also to the address on their letter.

      3. The fees breakdown that was sent to the council and then over to me via the council states a starting total of £334. No-where do I have this figure in my letters. I have £110 for a traffic orders letter, then £223.90 for a notice of intended seizure and then £420 for a warrant of execution.

      On no occasion did I see or speak to a bailiff and I have not signed anything.

      I would appreciate any advice. Thank you in advance.

          The only thing I can think of at the moment to try and get a hold put on things is to call, followed by email to whoever at council sent you that email and show proof of that demand for £420-odd pounds which does not correspond to the figures that the council has sent you which they say their bailiff supplied. Ask why the discrepancy. Also show proof of email/proof of posting lettter to bailiff.

          Ask if they will take back inhouse. But wait for others to advise too.

            Thank you dementedfeline I'll do that today. May I ask just for my mind, do you have any knowledge of the fees and if so if they are correct? I have done some research and from what I can tell the attendance fees and the levy fees are not valid for a number of reasons -

            You can't charge for both
            They were both on the same day
            They are not valid as nothing has been levied and so they can't attend to remove anything
            There is no law to say you have to pay these fees.

            Do you have any knowledge of this area?
