PCM issued 2 PCNs for parking in my own space!

    So you tell PCM that you are the landholder of that parking space and they do not have a contract with you to operate in that space.

    Yes, report to DVLA. No reason to ask for keeper details.

      Any good? Will update when I get a response. I'm not going to hold my breath though, expecting the same "opportunity to appeal has passed, pay up!" letters.

      If this happens should I be expected to send them a copy of the lease and the tenancy agreement? Or is it their duty to prove that they have a right to ticket us?

        This is the landlord acting in direct breach of the lease. You have a right to the parl=king space as if it were part of the apartment. They are (through their agent) challenging your right to occupy the land let to you.

        Forget the parking company. Tell the landlords that they are in breac of the covenant for quiet enjoyment, and that they must call off the dogs, failing which you will sue them.

          Just to be perfectly clear; We rent the property from our landlord, who is the leaseholder of the property.
          In our very limited contact with the landlord, they didn't seem particularly aware of the parking situation so I doubt they enlisted the help of these crooks.
          I suppose I could contact PCM and demand who instructed them to police the spaces so I can go after them instead?

          It seems from your post that there are now two potential avenues for having these tickets dealt with.
          1. Being the original stance - The tickets were issued unfairly/wrongly/illegally because we own the space and don't need a contract to park on our own land, therefore they should be cancelled
          2. Being your new stance - Blame the person who instructed PCM for breach of peaceful enjoyment and have them instruct PCM to back off

          I'll wait for the response from Trace and update this post as soon as I can and decide whats the next best course of action!

            des8 ostell dslippy Well I'm at a bit of a dead-end here...

            I wrote the attached letter (Pic #1) to TRACE, who responded with this garbage (Pic #2) for like the 5th time (They just send these no matter what I write to them they are a complete brick wall).
            I reported this to PCM stating that I'd like to communicate with them only as their client is being ignorant, and received this letter from them (Pic #3) telling me that I can only talk to TRACE.

            I'm sure you see the problem here...
            Its funny to laugh at how ridiculous this is but I do just want this matter resolved as its been going on since May, so what might my next step be? I really don't think I'm going to get anywhere by keeping in touch with any party involved.

              Sorry, but links to letter aren't working for me.

              I'd be reporting to the FoS as Trace appear not to be operating fairly.
              If a debt collector presses for payment it could amount to harassment contrary to Section 40(1) of the Administration of Justice Act 1970. (worth a read)

                        Requested a final response letter and PCM said the matter is in Trace's hands. It took 2 emails and weeks of waiting but this is now Trace's response.

                        ​​​​​​​Will update when I hear from the solicitors!

                          A question worth asking is whether the fact that the parking space is part of your property under HMLR, means that the parking spaces are not part of the communal property. If so there is a real question as to whether in turn the freeholders have any power to licence any third party to manage it on their or your behalf.

                          It is worth looking again at the lease.

                              Still no news from solicitors. Should I contact TRACE/PCM or just assume no news is good news, and that the matter has been abandoned? I'd like some closure ideally
