  • Parking tickets court claim

    I have received a court claim for four parking charges my daughter apparently received when she was parked at the university of Hertfordshire. I am the registered keeper but my daughter was using the car at the time. My daughter worked at the university. She was parked in an area where you needed a permit to park in the bays. She did not park in a bay but in the area around the bays. She did not get any tickets so assumed it was ok. If she had received a ticket she would have known not to park there. I am going to visit the area this weekend to look at the area and the signage. I need to deal with the court claim so my first question is should I acknowledge the service and tick I intend to defend all of this claim? Second question, when should I say that I was not the driver? I can put a copy of the claim form up so you can see the particulars of claim. *Thanks in advance for any help

    If you have now received a court claim, had you not received letters previously ?

    Can you type out the particilars of claim ?

    Who is the claimant ?

    should I acknowledge the service and tick I intend to defend all of this claim?
    Yes do that now to protect your position against a default judgment - it isn't binding on you so you can change to admit/offer later if need be.

      ]thank you for your response. Yes I received a letter so I asked my daughter. She said she hadnt had a parking ticket. When I finally found a number that was not a payment only number I rang and tried to discuss the fact that we had not had a ticket on the car. The lady was very rude and said it was not an excuse. Unfortunately there are a lot of tickets handed out because its a uni and some students think its funny to remove tickets and put them in other cars so I can only assume thats what happened. I googled about private car parks and the advice was to ignore them. When letters kept coming I assumed they were about the same ticket so ignored them. Ill post the claim particulars shortly

                    Okay when does your defence need to be filed?(what date is the issue date of the claim?) has your daughter got a copy of her parking permit and was it on display in the vehicle at the time? Has she enquired at Uni about the charges?

                      The issue date of the claim is 6/12/19 The acknowledgement of service was submitted on 11/12/19. My daughter has contacted an old colleague that worked at the uni at the same time. He is going to speak to the security/parking team to see what he can find out. Being the Christmas holidays it might take some time. Her staff permit was displayed in the windscreen but could sometimes fall off. *I have since been down to look at the area and signs. I have photos and a video. Can I ask for photographic evidence? Is it too late to tell them I was not the driver?*

                        Unfortunately schedule 4 of the Protection of Freedoms Act 2012 allows them to claim from the keeper if they don't know the identity of the driver.

                        As the keeper they are limited to claiming the cost of the original PCN from you so don't know where the £640 came from.

                        If you still have a Notice to Keeper then post up a redacted copy, but leave dates

                              Added 33 days (28 plus 5 for service)
                              Absolute deadline for defence = Wednesday, 8 January 2020
