  • Letter from Direct Collections Baliffs/Regent Parking

    Hi guys,

    Hope all is well - just a bit of help required on this one.

    I have received a letter from Direct collections baliffs limited a few days ago and was really confused as to what it was for because it simply displayed no detail.

    I have since called them and asked them what it is regarding and they mentioned a 'PCN' which I could not recall

    They have now sent me an email with quite a few different letters from different collection agencies. The original 'PCN' seems to be from a company called Regent parking and it is from 2017.

    I have attached relevant letters, can someone point me in the right direction as to who I should be writing to as there seems to be a few parties involved in this process and also from which angle I respond.

    Any help is greatly appreciated.

          The original PCN failed to comply with the requirements of POFA on 2 counts that I can see on a quick scan. No period of parking and the warning of keeper liability is incorrect tly worded.

          The sign is also a prohibiting sign in that it is only offering parking to permit holder. There is no offer of a contract to park to non permit holders. No contract then there can be no breach. To claim a contract exists when it is expressly forbidden would be perverse.

            Direct Collections appear to be acting in the capacity of 3rd party debt collectors.
            If so, they have no legal standing or authority in your case, as they are not party to the alleged contract.
