  • VT - Excess Milage

    Hi.

I’m wanting to VT to get myself back on an even keel.
I’ve read some posts on here, and like others, I was told to put less miles than would ‘probably’ do by the salesman. And not to worry if come and got a new car. I know this is hard to prove. And the salesman was gone by the next year.

I’m well over 50% due to VWFS, but I’m around 40,000 miles over.
My circumstances did change 6 months after getting the car. Meaning my miles increased dramatically.
I think it’s £0.06pm over, so about £3,000 over my allowance.

R0b I’ve got and read your guidance. Thanks for that. But my question is; am I still in a good position to argue against the excess miles as they don’t fall under the terms if the contact is terminated early (VT’d)? With them being quite some over.
My vehicle has been regularly serviced, due to the miles, and so I’ve taken reasonable care of the vehicle?
My intentions were to keep the vehicle at the end and refinance. But I need a cheaper monthly option. And the excess miles are getting too much.

I’ve read a post who also dealt with VWFS, but it never stated how it ended up. Do they do like I’ve read BMW do, and put negative markers on credit files, in breach of DP?

Finally, are minor alloy scuffs covered under ‘wear and tear’?

Thanks for you help and advice.

It doesnt matter whether you have gone over the agreed mileage by 1,000 miles or 100,000 my view remains the same. The excess mileage charges is a contractual clause and that's it - it doesnt receive any special treatment over any other clause.

VW would probably argue reasonable care which I point out in my guide why that wont work so they have to look at other options to recover it. The only other option I can see is misrepresentation where you deliberately knew (or were reckless) in thinking that the agreed mileage was sufficient.

Limited options for VW but doesnt stop them trying as a good chunk of consumers get anxious with threats of legal proceedings and end up paying anyway, its psychological.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

Not really, because there's nothing that I will say which hasn't already been said on this forum.

I've updated my VT guide with more information so it should help you to carry this on your own unless you get to the stage of legal proceedings then I am happy to help where I can. There is an extensive piece on excess mileage, I suggest you read it and get yourself up to speed.
