Disputed Council Tax

This might appear to be one of the most stupid questions placed on this or any forum, but believe me there are very strong reasons for asking.

If a council lawyer goes to court with a statutory court order saying a person owes council tax, and documents are placed before a court giving evidence of this owed council tax, then legally this is council tax,right? And therefore any cash paid, legally belongs to said council and no argument, again right?

Money was paid by the way. Just in case anyone is scratching their heads, this involves fraud.

It's unlikely a council solicitor was involved (although some councils may use their solicitor) - the powers are usually devolved to a designated court officer to deal with the court. There's not too much needed in the way of evidence - effectively little more than the list of the cases the council state are outstanding and a declaration to say everything was issued correctly.

After this I'm a little lost as to what the issue is - can you add more to the situation to clarify this part "legally this is council tax,right? How much is the council saying is owed and in respect of who and what. Any proof of what they are demanding has been paid?

Intrigued.

It's a long, long, long story,but the sum - just under £1400 - started out as costs owed to some ( very dodgy) lawyers hired by the council. These costs were highly disputed, but at the end of the road, same solicitors labelled same costs as "council tax" with stat.order saying this money owed to same council.


NOTE: Not owed to them as stated on court papers,but this cash was paid to these lawyers.


No-one noticed the switch until later, but as the final court session "blessed" - if that is the word - these costs as owing to a particular council, then I am arguing that it should be paid to the local authority.


This particular authority by the way, pretends this hasn't happened.


This is long and complex, and I am tweeting about this, but will not give it out here, as life is too short, unless anyone is really interested.


As stated, fraud is involved, and it is fairly clever, but not clever enough as it was uncovered.
