But did you pay the amount they said was due (on the CT bill) for each installment, or did you just divide the total by 12 and pay that?

To have a 12mth time period to pay a CT bill (instead of the usual 10) you would have needed to arrange it with your council in advance.

The payments being made are as per the council tax bill ie 1/10 of total bill I could have paid 1/12 if I had set up a direct debit but I do not do dd's as I dont trust the banks or council.

if you are paying the amounts shown on the dates shown in the CT demand letter, I cannot understand why they've taken you to court and got a LO :noidea:

Is there any outstanding/disputed liability relating to a previous year's account? If so, the explanation may be down to the Council Tax processing software misallocating payments.

I have not decided the amount but paid the amount requested on the council tax invoice issued at the beginning of the year. ie initial payment 152.50 followed by 9 payments of 150.50.

Roughly 36.5 days per payment 365/10. As at todays date paid initial amount followed by 5 payments which in my book means I have paid 219 days which equates to November 5th 2015.

Don't most CT bills have a date of payment on them (I know mine does)? If you didn't pay the payments on or before the dates specified on the bill then it'd show up on the council's database as in arrears :sad:

Having said that, you don't get a LO just like that, they send you two reminders per tax year followed by a summons.

Payment is always made by council telephone payment service between the 25th and 28th of the month. The 36.5 is just a red herring to show the front loading over 10 months than 12 months although I could pay by dd a lesser amount on the last day of the month and have none of this aggravation.

But if they totally ignore the payments made what can you do. The council tax final notice was issued on 15th Jul 2015. The notice starts out by saying. "Our records show that you are behind with your Council Tax payments" Well if the idiots had any brain cells 3 payments Apr May Jun would equate to 3 x 36.5 = 109.5 days which makes our annual bill paid upto 18th July 2015 so there statement is false.

It all depends on the council, when I had the issues I rang them because they'd issued me with a demand for the full amount outstanding for the tax year saying I'd lost the right to pay by installments, however, they could see I'd been paying every month so they told me about the dates and the fact that the whole process is automated, so even if the payment is made, if it's made after the due date, the system will flag it as 'arrears' and triggers a reminder, if it happens again it triggers a second and final reminder. They agreed to re-instate my installments but said I should be paying by DD which is much more convenient, although I do know people who don't like DDs, I've never had any problems since.

In that case, have a read of Annex E of "this complaint" soon to be submitted to the Local Government Ombudsman (LGO). The reference, i.e., Annex A to SD #3 is in "this link".

Have been watching that with interest. In my own case the £70 relates to the illegal issue of a Council Tax Liability Order as I have a written statement from the court saying that the court was not even sitting on the date the order was issued and the council has acted as prosecutor.

Having read so many threads on Council tax LOs and Bailiffs advice must be to pay up and then fight for recovery of money before Bailiffs are involved together with all the Shite that comes with it.
If you insist on fighting with the same claims of payments made you must get them to prove in writing they are wrong and you are right.

Just to update finally got my day in court today with council trying to get a LO for 2016/17 for non payment even though I have paid in the month around 26/27 and council admit they have received it but insist the due date was 1st of the month when in fact the 2012 Act allows for payment upto the last day in the month. I put my case forward quoting the 2012 Act and the magistrate agreed with me throwing out the councils LO request. Council seriously unhappy.
