  • Unfair Council Tax Demand from 2007 whilst on benefits

    Hi,

Ive posted on this forum before and have recieved great advice and I'm afraid I have to post again.

We've JUST dealt with an Equita issue regarding Council Tax and today we are facing new one. Today my mother recieved TWO letters from Equita dated on the same day demanding money for a "council tax debt" from 2007. The property we lived in from January 2007 - December 2007 was an emergency temporary accomodation. My mother was in reciept of benefits at the time as she was out of work and the benefits were sorting out the rent and council tax. I was only 15 at the time we lived at that property and still at school. Today my mother has recieved TWO letters from Equita, one stating that she owes the said council £585 and the other letter saying that we owe the same council £1029.86.

All we want to know is my mother liable to pay these debts as she was not working at the time and was recieving JSA payments at the time

If anyone could help we would be incredibly grateful.

You need to speak to someone at the Council and ask the following questions: 1 - how many Liability Orders they have against you 2 - the dates they were obtained 3 - the addresses they were for 4 - the period of time each covers 5 - how much each one was for 6 - how much is still outstanding 7 - the dates they were passed on for enforcement 8 - the dates & amounts of any payments

ok thanks will do that today! Its so stressful! We did speak to the council yesterday and they said they wrote to us in 2008, but we moved out in 2007, they were very unhelpful but we will ask them these questions

When you moved did you inform them? Did you move within the same Council area? Since moving have you been paying Council Tax for your present home?

Councils are quite notorious for charging after after you have moved citing that you never informed them & asking to provide proof of your current address via tenancy agreement or current CT bills

Yes they evicted us to precise because we were only in emergency temporary accomodation and had been there for almost a year, so they knew we moved. We also moved over 90 miles away into my mums own property. And my mums been paying her own council tax ever since then, only a minor hiccup this summer but they are fully aware we moved.
