  • Flying freehold deed transfer

    I'm in the process of selling my house in London and my neighbour and I have a deed of mutual covenant in place for a flying freehold that exists between our two properties

    This has been in place for over 20 years, and since I'm selling needs to be transferred to the new owner

    This should be a formality, the wording, transfer rights, etc being exactly the same, other than my new owners solicitor wants to add the clause ..

    8.​The Registered Proprietors of title number NGL736504 and NGL764327 shall apply for the entry of the following restriction against both titles at H M Land Registry simultaneously with the registration of any transfer of the Properties:

    ​“No disposition of the registered estate by the proprietors of title number(s) NGL736504 and NGL764327 is to be registered without the proprietors securing an executed Deed of Covenant by the intended/new proprietors in the same form as this deed”


    ...and my neighbour, who currently doesn't have access to a solicitor needs legal assurance

    Can anyone help please? I’ve tried for weeks to find a solicitor who can help. Also I’ve no idea how the concurrent signing works ?

      To start with you need good legal advice from your conveyancing solicitor. We do not have enough information to comment whether the buyer's solicitor's request is reasonable.

        the conveyanving solicitor has passed to problem back to us. They can’t advise neighbour. I think the clause is just a formality - I just can’t find a solicitor who can help my neighbour and turn it round quickly .

          Your solicitor shoud be advising you. Does he or she consider the buyer's solicitor's request reasonable? It is naïve to think that clause is "just a formality".

            Thanks again for your help
            I appointed this solicitor at the end of January and sent over the original deed then
            i cant even speak to her, constantly avoids me, and has made no comment whatsoever about this matter other than saying she would try to find a solicitor to act for my neighbour, which should ultimately couldn’t do
            i just can’t back peddle now , I’ve got too
            much at stake and time is not on my side
            frankly other than finding a solicitor who can act for my neighbour I don’t have any other choice
            I understand your logic but I don’t have time any more

              Did you select your solicitor on price?

              Consider complaining to her firm.

                Yes on price but with a degree of research
                I could complain but I need to resolve this problem immediately and at this stage I can’t see any benefit / I’m really pushed
