I'm in the process of selling my house in London and my neighbour and I have a deed of mutual covenant in place for a flying freehold that exists between our two properties
This has been in place for over 20 years, and since I'm selling needs to be transferred to the new owner
This should be a formality, the wording, transfer rights, etc being exactly the same, other than my new owners solicitor wants to add the clause ..
8.The Registered Proprietors of title number NGL736504 and NGL764327 shall apply for the entry of the following restriction against both titles at H M Land Registry simultaneously with the registration of any transfer of the Properties:
“No disposition of the registered estate by the proprietors of title number(s) NGL736504 and NGL764327 is to be registered without the proprietors securing an executed Deed of Covenant by the intended/new proprietors in the same form as this deed”
...and my neighbour, who currently doesn't have access to a solicitor needs legal assurance
Can anyone help please? I’ve tried for weeks to find a solicitor who can help. Also I’ve no idea how the concurrent signing works ?
