    I moved out of my former rental home in November. I had agreed to give my landlord two months notice (silly I know).

    I later agreed with my former landlord not to pay the final rent as he said he would deduct it from deposit.

    I stayed in the property for eight years and a month. My former landlord is now refusing to return the remainder of Ł300 due to "damages". Most damages he claims are normal wear and tear, I believe.

    My landlord insisted redecorating the flat when I was still paying full rent but had moved out. I didn't initially agree to that but he started threatening with action referring to clauses in the signed tenancy agreement.

    Furthermore, I am now facing a council tax bill for a "second home" which is actually higher when I lived in the property!

    I have made a full and final settlement offer of receiving Ł250. My landlord's counter offer is Ł100 which I have refused. The landlord is not keen to mediate. He says if we do so he'd be claiming more than Ł300 for damages. Equally I feel that I would question legality of two months notice but I must stress that I had agreed to that, hence not disputing it.

    I have notified him that I'm prepared to go all the way to the court. He's said he'd come back to me within a week.

    Where do I stand legally? In all honesty, some of his points for "damages" seem fair but I do not agree with the amount due to eight years tenancy.

      Did you inform the council when you moved out ?

      Re the Damages - what kind of things ?

      How much deposit is he holding and is it in a proper deposit protection scheme ?

        Hi Sharon, yes I notified the council, even explaining the situation in full ie moved out in November but paying rent until early January. They then sent my landlord the bill who disputed it, hence my getting the second home council tax bill.

        Damages included broken legs in sofa (which I'm not disputing), broken washer dryer (washing worked perfectly well, never used the dryer), fallen blinds (not properly fitted according to his own builder), some rubbish left (which he said he was happy to remove), broken waste disposal unit (which I wasn't even aware of), alleged damage to bedside tables (never used them as I had my own) and a mark on a shelf. Yes, lots to claim but mostly debateable me thinks.

        The deposit is protected.

        To add, all those items were there when I moved in. He's holding Ł300 but saying he feels I owe him money but is now happy to return Ł100.
