      The claim pack was addressed to us BOTH to my Mums address, my address itself ?- Is different but I had let the My Deposits team know (when they asked me where the landlady should write to me) that my mums address could be used as a care of too.

      The problem here is that I believe we should have received TWO letters, but she (claimant) will say she sent two packs to us both in one envelope and she hasn't.

      Nothing has been filed to my address despite that she wrote to me there last year.

        You have both claims though. Just your argument is that your mum didn't receive the claim. But as its same address and both were in one envelope that can't really be argued.

        You'll have to go with something along these lines then...

        On xx/xx2016 a letter was received at xxxxxxxxaddressxxxxxxxxxxxxxxx from the claimant.

        The letter contained claim form A, claim form B and a single response pack. We thought this was a joint claim as there is a single claim number and both claims are identical, I was under the impression that the claimant had simply duplicated the claim form and my daughter submitted the defence accordingly.

          Also- there is no said district judge on the Judgement for claimant- This judgement has been sent from the main court County Court business centre in Northampton and we live in Somerset- I am guessing this set aside will be used to ask them to be sent to a local court ?

            Yes the set aside will transfer the claim to the WSM court, your side with the defence will be sent over there too after you have completed directions questionnaires.

            The DJ is Deputy District Judge Murray Smith - it's on the Order from the court dated 20th January

              I have just seen! The business centre had sent the proof of where the claimant had issued the claim forms- now under my name DEF2 - IT SAYS that the claimant had issued a claim set to MY address.

              Now that is odd as I have not ever received anything- and in my EMAIL reply to MyDeposits last year I stated that the claimant should use my Mothers address as a corres address for me- and gave them my Mums address.

              As such she will claim that two packs have been sent- to both addresses (despite that she does not know that MY address is where I now live) - She was as I say- given my Mums address to contact me at for any further dealings.

              What happens now ? :?

                  ACCORDING to Kathryns House- the image they sent me (sent to Kati just now to upload) shows Mum DEF1- ADDRESS-FRENCHAY RD and next address as Osborne House.

                  DEF2 ME- SEPT 14TH 2015-C/O (my mum)...(cant see address)
                  Address-20th Jan 2016- BouleEVARD address (mums)
                  Address-27th JAN- MY ADDRESS

                      So is that the entries from the cert of service that the claimant entered ? because the application and the order only has the 49 B*********** address on.

                        It would appear so....September I guess the court would have issued the FIRST set of claim packs..come January 20th the claimant appeals to amend address to 49 Boulevard.

                        As yet I see no appeal to amend to Arundell Rd and I say - that address was (in an email I still have) told to the My Deposits team- that it was not secure so to send anything to my Mums address at 49 Bou*****

                        I see she tried to file the claim sept 2015 to C/O GW- but as I can not see the address I assume it was to Frenchay or Osborne as that is the addresses she has for my ,Mum.

                        You can see where the confusion is- as per her amendment 20th Jan-'The claimant shall re serve claim form and response pack' .

                        She is obviously doing this herself and has not served anything but claims she has despite the the ARUNDEL******address was not told to her as being a secure address. Obviously she thought she'd 'give it a go' to see if I was there.

                          Ahhh well. Okay the main point is that you received only one claim ( duplicated it appears) pack at 49 *********** and Defendant 2 entered a defence. No other documents were received at any other address and the judgment should be set aside or at least put on hold until the case against defendant 2 has been heard, and if defendant 2 succeeds there is no claim against defendant 1.

                            Should I write that ^^ in that Mums defence (I am with mum now) -I am just very aware that I need to sound as polite as I can without sounding arrogant

                                Hi all �� I filed the set aside with mum... Thank you so very much !

                                On what grounds could I counterclaim ? The LL was harrassing me and allowed her friend to go through my belongings. I ended up staying out of the property 9am to 9pm every day or taking trips away.
