    A law degree may give you insight but does not make you an expert , in addition law changes frequently and may not be publicised
    With all due respect indeed, I offered OP advice which was largely mirrored by the solicitor. I am still aware of remedies at equity and when they're not, ie stay of eviction.

        How was it the other way around when I told the OP exactly what they could do to defend the possession? I explained how property law works, ie legal and equitable interests, and affecting mortgages, explaining redemption and referred him to the relevant statute and relevant case precedent. Hmmm

          Been to court today and thanks to the help given by members of this forum, in conjunction with a the help of an adviser from Shelter and backed up by advice from a qualified local solicitor, the Judge has adjourned the hearing until mid February on a combination of technicalities, incorrect information on the claim form and the requirement for the claimant to provide me with a witness statement. Although the matter is not over this is a great result and as suggested above, buys me time to try to negotiate further with the TSB and/or raise some funds.

          A bit of advice from me to anyone facing a similar position, - Don't bury your head in the sand! Pick up the phone and seek help asap. Shelter.org is a goldmine of firsthand information and advice!
          Thank you to everyone, for your input I will keep you advised of any further developments.

            That is good news Shelter are indeed very good, I'm glad you managed to get the adjournment. Gives you a little bit of breathing space to get some proposals sorted to the bank.
