Are HSBC allowed to sell the charge they have on my property to a private individual?

  • Are HSBC allowed to sell the charge they have on my property to a private individual?

    HSBC have a charge on part of my property, I have an ongoing Court Case with HSBC regarding this charge and as part of the process, I sent a SAR and upon reading all of the paperwork supplied , I can see that another person, (a private individual who also had a charge on part of my property), has tried to negotiate with HSBC to buy out HSBC`s charge, and there are letters between the two parties? Surely this isn`t allowed as this private individual would not be bound by any financial regulatory bodies for a start, also, should HSBC be discussing my business with a private individual?

    Any advice would be gratefully received.

      Has the private individual actually purchased the charge or have they been negotiating ?

      A charge can be transferred between parties yes. The charge against the property is listed on the land registry so is in the public domain.

      Might assist to see the letters between those parties, and know a bit more about the private individual with a charge over your property.

        AMm I right it thinking the person with the charge trying to buy the banks one has some other agenda or ongoing argument with the OP

            Thank you everyone for trying to help me, I really appreciate it. Yes I know the person who was attempting to buy the charge, it was a friend who gave me a loan secured on my property until such time as I received monies I was due.
            I have now paid off the loan to my friend, but have now found out through information provided through my SAR to Hsbc, that that my 'friend' had been trying to buy HSBC charge and so wondered if that was another thing HSBC had done which they shouldn't have done?
            Are the bank allowed to give information about what I owe them to my friend without my permission? Am I not protected by the Data Protection Act?

                As Amethyst said, the charge is a matter of public record, so it would help if you could share the content the the correspondence between HSBC and the 3rd party before anyone can tell you if they have broken any data protection principles.
