  • Family Land Inheritance Situation

    Hello. My name is Joseph Whitmorestewart.
    2 and a half years ago I lost my mother and all of her assets automatically went into my stepdads name.

    My Grandad on my mothers side died and left a piece of land to her name. This land is in cambridge and has river frontage and a nice 3 acre inner field.
    When my mother died the land went into my step dads name.
    And now he wants to sell the land off and spend the money.

    This land is my birth-right. My inherritance intended from my mother to me and my 2 brothers.

    Is there anything i can do to stop this happening as it will break my heart to let this lovely land just be sold?

    It sounds like it was left to your Mother and was passed to her husband (were your stepdad and your mother married?) on her death. Did she die intestate?

    If there are surviving children, grandchildren or great grandchildren of the person who died and the estate is valued at more than £250,000, the partner will inherit:

    all the personal property and belongings of the person who has died, and
    the first £250,000 of the estate, and
    half of the remaining estate.
    Children - if there is a surviving partner

    If there is a surviving partner, a child only inherits from the estate if the estate is valued at over £250,000. If there are two or more children, the children will inherit in equal shares:

    one half of the value of the estate above £250,000.

    All the children of the parent who has died intestate inherit equally from the estate. This also applies where a parent has children from different relationships.

      I have no adress

      Hello My name is Joseph Whitmore
      I am currently living in a field on my step fathers piece of land,
      It is off grid, and unofficial. I have run into a problem, i need an adress to send post too.
      My family wont let me send post to their adresses on account of me being Bankrupt.
      Also being bankrupt means i cant rent anywhere because i have no credit score anymore.
      So i am having to live Unofficially/Illegally on this piece of field with out an adress and mains!
      PO Box Adresses seem useless as i cant send bank info or insurance info to them.

      Do you have any advice?

        Is this the same bit of land your stepfather is selling after inheriting from your Mother ? Possibly best to keep the issues together as they are related.

        If so then '' If the date of death is before you went bankrupt your inheritance is an asset that you owned when you went bankrupt and it therefore belongs to the OR. ''

          Yes its the same piece of land. so your telling me that i wont ever get my inheritance? is there any way around this?
          And what would you do if you were in my shoes?
