Maybe a silly question but are we supposed to take this judges questionable interpretation that all pre 2008 secured loan of £25k+ have no protection?

Or are swift a special case as they aren't officially a bank?

No it is just a fact (second charges obviously), at least they are unregulated by statute.

But as discussed above didn't the URT bring previously unregulated second charge loans under the CCA, well s140 anyhow.

No it does not work that way unfortunately, section 140 just applies to any agreement, it does not mean that the rest of the act does.

Sorry got to go out now but from what you're saying the UTR can be used but the UTCCR cannot? Bizarre, as the UTCCR is presumably all consumer contracts not just credit ones.

As you may have seen I'm waiting for details as to why Firstplus received a CCA 33a Requirement Notice (as SWIFT did) - see OFT section re my PHSO complaint. The CMA are now trying to find a way of not telling me.

No regulator (past), no guidance, no legal aid, beyond the FOS, beyond the CAB, beyond the FCA (present), beyond most peoples comprehension this actually can happen as well as the other myriad of consumer protection anomalies that do not apply.

JUst for everyone to know AND any Swift troll/spy who read all about what is said about SWift on all public forums.

It hasn't gone unoticed that A High Coupt Injuction has been obtained against 8 of the companies of which Swift Advances plc are one.

It also hasn't gone unoticed that less than 1 month after this injunction was obtained....a new company was set up in the name of Kestrel Loans No 4 Ltd with its registered office in Arcadia House.
Question: Why form another Company as a 4th Kestrel Loans company when they already have 3 others that are dormant??
Maybe Swift would like to comment on this actual thread and explain all this
Just for the record for Swift a watchful eye will be kept on this company.....by EVERYONE

No 4 Loans is mentioned in above post.... BUt I must admit missed the No 4 Ltd....
Bought to be an SPV........now that they can't use Acquisitions.....told you there was fraud going on before .........they have been unlawfully using Kestrel 1,2, & 3 in the past ....they weren't SPV's....I do think the letter I sent to Mr M**** will interest him very much now.
Both bought and names changed on same day............they do seem to be quirming,...... twisting and turning....and wheeling and dealing.............12 companies being run by Two Directors...Oh I forgot..... along with their 120 odd band of willing money collection gang.
Remember how the American Mafia gangsters used to keep two books of accounts.one for "The Firm"....and one for the taxman..........Swift and Kestrel accounts same idea and plan....about time people saw through it all

Make contact with J& G and GH over there..they are thinking of gettig a few Swift Borrowers who have lost their homes through Swifts underhanded tactics( to say the least) and getting the Asset Recovery Unit over there to do some " investigating" the ARU is aware of what Swift have been up to over there......GH has already been the cause of Swift " backing off in his case" last year.....he had them over a barrell with the criminal use trading styles, the Bexhill|& Melbourne Mortgage cases were being used against them, PPI mis selling and UTTCC's.

Dare not touch him.....they would have lost completely......Swift do not want a case like that to be ruled against them..................but they have a big shock coming to them Very soon in this matter.
Just because they have paid their debenture off..the fraud of it is actionable for another 10 years

Been in touch with J&G and they are unaware of what you are talking about??

PS......I've spent a fair bit of time trying to get your audio and visuals to sync.....checked a few forums and they allude to there being an issue with sync'ing in your version, however they do recommend upgrading your version of movie maker.

Never mind.........probably me misunderstanding as usual.
Re upgrade of movie maker.....I'm still running XP and can't upgrade cant afford upgrade to windows 8 nor a new computer ..so I'm banjaxed on that........Have to try and borrow a good digital video camera.

Got myself a hold of a digital Video cam corder. ..now I have to get my feeble mind on how to use it as a webcam to record my videos then away I can go and let everyone know what Swift are up to :biggrin1::evil::whoo:

Just try and liven it up a bit Sparkie, someone told me they saw the last one and just saw a dowdy ole man droning....nothing personal cos they didn't know you, but....put on a bit of make-up and a frilly hat and laugh now and again...or something like that!
