  • Adverse Possession (Unopposed)

    Can anyone supply me with the ball-park fees that are likely to be involved when dealing with an unopposed adverse possession on a small piece of land (approximately 20 square metres)?

    We have occupied the area for approximately 15 years and no-one else has been near it during that time. We always thought the land was ours and we have gardened and fenced it etc as it were our own. It now turns it belongs to someone else. They're not making a song and dance about it but we would like to legitimise the garden before anyone changes their mind.

    Also, again bearing in mind the matter should be unopposed, can this sort of thing be done by a layperson?

    I fully understand the problems can be problematic but having read the Land Register documentation, an adverse possession seems possible.

        I had already checked with the LR for their fees (these will be quite small); I was hoping that someone had done this sort of thing before and would be able to give me an idea of solicitors' costs. However, on reflection, that's probably a difficult shot. Not to worry - many thanks.

            It's hard to be absolutely sure.

            Whatever, before I put any paperwork in to the LR, I intend to ask them (the owner) if they intend to oppose an application; and if they do, on what basis. If it looks their opposition might succeed, I'll probably up sticks and go home. If they won’t tell me why they’re objecting, or just because they don’t like the colour of my eyes, I’ll probably put an application in, to see what happens.

              should ask them 1st ??? cannot see people giving property/land away, could be retirement plan for the future, and taken that you may be taking the land as your own under misconception in the past??? just a thought, sooner you ask them to sell to you or whatever the best, do not take them for granted be careful. Law of Property comes to mind? just a thought, sure others will comment further/advise?
