Re: Section 21 notice and Landlord

It was adjourned generally with liberty to restore.

the advice person there who was representing the other side was not happy as legal4landlords didn't even send anyone or even tell them that we had vacated the property.

Well done, I'm glad this has worked out well for you. Good on you for standing your ground and not be bullied.

Just a wee point regarding the adjourned with liberty to restore, presumably the restore would kick in if you fail any of the instalments of £200 a month - make sure you keep strict evidential records of those payments you make.

And I think Inca can get away with using naughty words this once

Well done - I am REALLY pleased for you, and all who helped. Clearly Plan B was very good to you.

As with all things court, it shows that most of the time they are sensible. If they can see someone has tried their best to resolve something, they are very likely to side with that person, and be unimpressed with the 'authority' who is throwing their weight round just cos they can.

A victory for you, but more importantly a victory for justice and fairness. :beagle:

Nah, this wasn't a case of a court siding with anyone. There was no discretion used. The Landlord hadn't served a section 8 Notice so had no legal right to claim the rent arrears. The Landlord had agreed to discontinue the case so proceeding to court was an abuse of process

All credit goes to Woody for bringing these fundamentals to the court's attention.

Woody won on law not on a sympathy vote :violin:

From my background I knew to note everything as you don't know when you will need to use it.

even the legal advisers on both sides didn't know why this was being heard in court.

Can you clarify whether the court order simply says "adjourned generally with liberty to restore" without any conditions attached? Or was the £200 per month was written into that order :noidea:

We will get a copy of the order in the post but they said just pay the £200 on the 1st then that's it. Once I get the copy I will update you.

LOL - celebrate in style. As I said, good to see courts being sensible - they usually are, thankfully. The wonders of the British justice system working as it should.
