You do not want to be worrying about suing anyone , you should be concentrating on stopping the eviction.

Can mindful confirm if an application was put before the court stating children were an issue on eviction, and you are not connected to the owner

                It's a long one

                http://www.legalbeagles.info/forums/...npaid-Mortgage

In brief. I believe my rights as a tenant change because I'm not supposed to be here. The LL didn't inform the bank.

LL has terrible temper and didn't want to put an N244 in, as he promised he would do that.

LL came today to confirm put N244 in last Thurs.

He tells many lies and I am hoping this is true. I don't know how long the process is for an N244 to go through. I do have 10 days for this to be sorted even if I end up putting my own N244 in.

My hope if I'm too late is to fight it if the LL doesn't pull through and to know the laws. Then put a stay like my local council has told me!

I posted this thread with just rules for info. If any subsequent updates are out there. Would be ever so grateful for...

                  They just ignore them.
It is the council that hires the bailiff therefore the bailiff has implied rights to enter our premises from the council, it is the council that applies for warrants not the bailiff its not his debt he has nothing to do with anything only the collection of that debt, nothing else. We can remove that implied right as we can choose whether to agree to the bailiff or not, open the door and you agree, keep the door closed and the bailiff is as powerful as a field mouse.

Basically if push comes to shove my question is

Can a tenant be evicted when it says "occupier" on the eviction notice.

My local council are telling me "NO"! :faint2:

                        Excuse me?

This eviction has nothing whatsoever to do with the council. The possession order was granted by the county court (not the Magistrates Court which is the case with Council Tax and other Local Authority debt issues) on behalf of the claimant (her Landlord's lender) because of arrears due to the mortgage providor.

The OP has no debt to the council or anyone else :nono:

You have no knowledge of our rights concerning bailiffs so please be silent.
