Thanks for the PM and and I stated there and I will here. If you find any poster's reply rude then by all means hit the triangle button and let site team take action should they feel it necessary.

The clarification on the issue of did you read post one is that the OP said this: "Landlord has told me that his mortgage company does NOT know he is renting out!"

In the link provided one of the questions is about that issue which lead me to the question of eviction on one of the questions in that link from shelter which followed the logic given. I then read a few more questions after that and picked up on the other points.

    Hope that explains the logic.

I'm sure the OP wants to move out but the bottom line is that unless he's evicted before his tenancy expires he's not entitled to have his money back

Again i agree with you i would bet the landlord owes loads and has no equity in the house he might even go bankrupt to write of the shortfall and other debts after the house is repossed, also no doubt everthing else he has is owned by another family menber, the OP needs to hope he stays until all the rent is used up getting a deposit back is doubtfull to,Whatever he will come through it all in one piece i hope lesson learnt here for otheres?

At least the landlord isn't Karl Nolan, who is said to like sending fatuous Statutory Demands to former tenants and their relatives.

Something else to think about is whether the lender would be prepared to keep you on as a tenant if you pay the rent direct to them This is often an option. Who is the lender because they can vary in their approach?

I have to go out now too. :bolt:
I wouldn't want to stay here. Too many DCA's looking for the landlord. I even have Removal of Implied Right of Access plastered on the entries to the property in order to deter any bailiffs. Also the cost to heat the place is horrendous due to the damp!

By the way the lender is Birmingham Midshires.

It means that you have to provide a copy of your tenancy agreement if one exists(and I hope it does) and proof of rent payments so bank statement with the yearly rent paid in advance.
Have printed off the N244 so well prepared for court notice in advance. Thanks for that. Also considering putting a charge on the property via a commercial lien

If I can stay until the end of my tenancy then thats a bonus. As far as the 2 months damage deposit goes. Well... I am in furnished accommodation

That's interesting. Birmingham Midshires was taken over by Halifax which was taken over by RBS which became BOS which became HBOS which was taken over by Lloyds TSB :blah: :blah: :blah: in the 2008 Credit Crunch Chaos (something like that). My point is since then the lender has become more aggressive towards repossessions because it has to pay back the Government the money it was lent by the taxpayer within a limited timeframe.

You may think none of this really helps you except my feeling is that if you contact BM and tell them your situation they may (may not) agree to suspend the eviction warrant to a date which suits you (i.e. end of your current AST in June) knowing that you're in occupation. If you don't ask you don't get
