        Okay, think you should write seperately to Solitaire with your dispute over their handling of your account and cc it to the DCA with this letter. The DCA wont sort out problems with Solitaire but they can hold the account whilst you sort the issues direct with them.



        Dear Sirs,

        Reference xxxxx77/sol1

        I am writing to confirm details of a telephone conversation held today at approx XXam, 4th October 2010, with Becky.

        The account, which you appear to be collecting on behalf of Solitaire Property Management, is for an outstanding sum of £694.69. The amount of £694.69 apparently due Solitaire Property Management is currently in dispute with them. A copy of a letter to them detailing the dispute is attached.

        This sum is for partial arrears of ground rent and advance payment for ground rent for the period to January 2011.

        In addition to this further charges have been imposed on the account of £146.88 from your company, and an additional £50 from Solitaire, bringing the total you are claiming to nearly £900.

        As far as I can see these charges are unjustified and there are no contractual arrangement allowing for the addition of such charges.

        Please can you confirm, in writing, the breakdown and relevant terms allowing you to add £146.88 to the account, and also please confirm that, as Becky advised, you will be freezing any further charges and interest on the account whilst the matter is being investigated. Could you also confirm if you are acting on behalf of Solitaire Property Management or if you have absolute assignment of this alleged debt.

        Once these matters are resolved satisfactorily I will be happy to discuss payment of any legitimately owing sum by way of monthly installment at an affordable amount.

        In addition to this please be aware I wish to correspond only by letter or email, so that I have a record of our communications.

        I look forward to hearing from you in due course.

          thanks for reply to my last message sorry i havnt got back to you sooner, i work away from home, only have comp at home. So sometimes difficult to reply straight away. The modifired letter was great much more professional and not ranting like mine!going to send it to them today and see what happens. Thanks again for your efforts! xx

            i received a response from the debt company yesterday, they still don't give a breakdown of there fees? With regards to paying them, im i legally obliged to pay them at their suggested amount, or can am i within my rights to offer the monthly amount i can afford?

            Thank you for your below email in relation to the service charge and ground rent on the above property. We have been instructed to collect the arrears on behalf of our client Solitaire Property Management.

            Your Service charge and Ground rent was due on the 1st July 2010, and due late payment the file has been passed to us to collect the arrears and our fee has been added to your account as a result of this. Although a payment was made to our client on the 7th July 2010 for £365.63, this still left an outstanding balance on the account.

            In the terms under your lease it will advise that you may incurr extra charges if late payment is made. Please be aware that once the file is passed to us (PDC) do add any extra charges other than our fee of £146.88 unless a payment plan is agreed or your file is referred through to legal action.

            We therefore must request that you contact us directly by the 20th October 2010, to arrange payment of the outstanding arrears for the amount of £900.32. If you are unable to arrange payment in one transaction then please contact us directly to discuss your account and try to arrange a payment plan suitable.

              Hi Ame, sorry to bother you, interestingly i have just received this email from solitaire doing my sums, it looks like that the option they are suggesting comes in at a total of£ 693.78! not adding on any charges!! an oversight, or a case of the right hand not talking to the left hand? it is a direct debit they are asking for of £231.26 a month, could they change the amount to accommodate the charges or would they not be allowed to do that because i have it in writing what they have stipulated? i have included the email i received below

              Firstly I would like to apologize for the problems you have experienced in getting through to us.

              In regards to the payment on your account, we do not set up standing orders you would have to set up a direct debit which would most likely be three payments of £231.26 as your next service charges are due on 1 Jan 2011.
              Un fortunately we are unable to set up a payment arrangement for a longer period than this due to the next service charge period, alternatively you can set up a payment agreement with Property Debt Collections, they may be able to offer you a longer time period.

              Please confirm acceptance of either payment plan by email.

                Just seen this thread, lizzy, you will find that Property Debt Management are actually a Peveral company ( just like Solitaire ) and all collude together, I also am having problems with these people, however I believe that I will now be taken to court as both PDM and solitaire are claiming that they have none of the correspondance i have been sending them over the last 3 years!! Although I wouldn't want you to take my advice and let them take me to court, the more people that stand up to this bumch of robbing cowboys can only be better in the long run for the numerous people that are being threatened and bullied by these morale avoiding not better than dick turpins!! Good luck and be strong in whatever you decide to do
