  • Help with Northern Rock's game playing please!!!

    Good morning All,

    After my victory in court on Wednesday where my eviction was suspended, I came home from work yesterday to a letter from my friends at Northern Rock.

    They have confirmed the arrangement however, they have told me that the amount I should pay is £163 a month more than the judge ordered.

    What do I do? The Judge stated that if I did not pay then they could evict me without futher notice being given.

    I can't help but think that they will resort to anything to repossess my home.

    Do I call the Court? Send a letter to Northern Rock and copy in the Judge?

    After the way they have treated me I don't trust them and can't leave anything to chance.

    I'm not exactly sure, but I would think a call to the Court straight away is your first step. Is this £163 more than the Judge ordered on Wednesday? Or on Wednesday did he confirm that you should stick to the original agreement? Sorry it's a bit early for me and I can't remember what it said on your other thread.

    and in the meantime, pay whatever you are supposed to be paying, and keep a record of all payments.
    When you have spoken to the Court, put it in writing to Northern Rock exactly what the Court said, send it to them with a copy of the Judge's Order, and copy the Court in too.

    I know this will automerge - I'm a bit more awake now lol.

      It is £163 more than the judge ordered. When I called NR regarding the illegal charges they had made they told me then a different amount.

      I think they will just go to any lengths to get me out!!

        You should pay what the Judge ordered you to repay. Write to NR and point this out to them and tell them that you are going to report them to the Law Society.

            Me neither

            They have mentioned the unsecured element of loan and that is what they have used in their calcuations. This was all supposed to be put togther with the mortgage in 2007. Yet again NR didn't. I can't believe that a major financial institution would act in this way.

            They will be in trouble if they don't listen to what the Judge has said.

              You need to put all this in your letter to them. Remind them of exactly what was agreed in 2007, what the Court ordered etc etc, what has happened now and so forth. If you want to draft one up and put it on here before you send it then please do

                Do you have a copy of the order from the court. Can you explain this bit about the unsecured loan that seems to be seperate. If it is seperate then thats a seperate negotiation to be made with them. Need a bit of background on it though. Was the other loan mentioned in any of the proceedings?

                You pay what the the judge told you to,as the others have said, and make it clear those payments are to the mortgage account, and keep records and receipts of those payments. Then that side, and your house, is safe.

                  Many thanks for all your comments. Northern Rock class the un-secured loan as secured when they want their money but have tagged the repayment as an additional un-secured on the letter they have sent.

                  I have spoken to the court who have told me that the Judge has ordered I pay £1500 per month off of the whole amount.

                  Northern Rock are unsure as is their legal representative.

                  I am still awaiting the order which I will fax to them the minute it arrives.
