20 years ago we modified upstairs at to have self contained 'flatlets'. This was in 1989/1990 an I have told the council it was to provide for teenagers to have their own space. The council now say I have to apply to 'legalise' these modifications and a charge of £335 will be made. As they have existed for 20 years it seems a bit of a cheek. We contacted the council by telephone at the time and were told that unless we created new front doors into the property the council were not concerned. Now the person I last spoke to(about 2 weeks back) says we must have 'got away' with it then and now have to go through this legalising process. On top of that they say that I have to prove that the modifications were done more than 10 years ago. Who keeps receipts for 20years? Any ideas?

What about photographs? Have you got any from over the years??? Some may be dated............

Have you had the house revalved/surveyed in that time - perhaps an old survey help prove the modifications are over 20 years??
Any chance of contacting the builer that did the work at the time and asking him to write a supporting letter.
When we brought our house the people we brought it from had work done in the 70's (knocked walls down, coverted outside loo and coal shed into the kitchen etc)
Our surveyor picked up on this and the mortgage company asked for proof that the modifications were over 25 years old, so they sent the solicitor pictures of their kids in the rooms when they were little to prove it. Our solicitor and mortgage company accepted this as proof!!! We also had to take an insurance policy incase the work was defective, which cost us about £175.00

Don;t really have much in the way of photos (teenagers tsk), have letters addressed to residents and I guess affadavits from the people who lived in the flats. Building work was all self done and there were no external changes at all, simply bedrooms converted to provide kitchen and bathroom space as well as bedsitting etc.
I lived in one but don;'t have any pics from the time.
Does any one know if the council is acting correctly in asking for this information and whether this fee is correct ?#staysafestayhome

I am not sure about the councils position but when selling a house old extensions etc can be a real headache. When we sold our last house there was a 70s dormer extension for which we could find no paperwork ( we did not build it) and it caused all sorts of delays and problems. that apparently is to do with solicitors protecting themselves about being sued about building regs etc ( complicated case law) but a buyer can take out insurance as mentioned above."What makes the desert beautiful is that somewhere it hides a well." - Antione de Saint Exupery

What triggered the Council's interest? Sale of property? Further works?
Is it retrospective Building Control certification they are seeking to ensure the flatlets are safe to occupy?
