  • Ending a lease contract with a estate agent

    Hello,

Thank you for accepting me as a member.
I have my house leased to an estate agent for 2 years whilst I was living elsewhere. So the estate agents give guaranteed rent and hence that fact I had to sign a lease agreement with them.
The contract says that I have to give them a written notice to acquire the house back and they should be able to hand back the property in 3 months. It's been 6 months and they still haven't been able to hand back the property. They are not taking their tenants to court. Instead asking me to take them, the estate agents, to the court. Then they will take the tenants to the court.
It sounds like they are going to use the my court papers to get the tenants evicted. Cos I don't see why they would only take their tenants to court, after we take the estate agents in, or issue summons.
In the meantime, I am paying rent elsewhere.
    How do I approach this?
Can I claim my expenses from the estate agent?
I don't have funds for the court fees or a solicitor.

    Thank you

You will need to bring a county court claim. You may apply for remission from court fees. And yes, you may claim expenses.

Possibly a daft idea. Have you suggested to the agents that if they are asking you to get a court order they will pay for solicitors to do this for you and cover all court fees and associated expenses?

I wonder if the agent has not done things properly at the start of the tenancy so that they cannot issue a S21 to their tenants...I would find this out - if this is the case I would say the costs of eviction should be theirs
