    Looking for some help guys and opinions,

    Both my anti-social neighbours have put up flag poles,
    with an easterly wind one neighbours flag is encouraging my gardens airspace,
    and with a westerly wind the other neighbours flag is encouraging my gardens airspace.

    Both flag poles are about 700mm from the boundary fence, and both flags are about 1800mm long, so up to about a meter of the flag can be in my gardens airspace.

    I do not want the flags in my gardens airspace,

    How do I go about getting these flags out of my garden?

    All options will be considered!

    One of the neighbours is a narcissist.

    Hi GoodBadUgly

    Gather evidence, i.e. take pictures etc, just in case you need to escalate the dispute. I would write to both neighbors in a 'cordial' letter, explain the issues and what you would like them to do, give them a deadline to move the flag poles. Send the letters Recorded Delivery so they have to sign for them, they can't deny that they were ever contacted. In the letters explain that they are interfering with the use and enjoyment of your garden (they are a distraction).

    See how you get on and report back.

      How tall are the flagpoles?

      Do you think this may be for a one off occasion eg Euro 2020 football?

        I have already sent a nice polite email to one of the neighbour's with photos showing issue,
        with no reply yet. I do not expect to get any response from either neighbour as this is a deliberate act from both of them.

          Nothing to do with the football, the LA have been notified as both flag poles require planning permission, and they do not have planning permission. But the LA are very slow to do anything about the height of the flag poles.

          As for trespassing / encroaching my garden the LA are not interested as they say it is a civil matter....

            How do you know It's nothing to do with football.

            If there is a breach of planning laws, up planning department to take action against property owners

            If there is trespassing / encroaching your garden !

            You could see a solicitor and take legal action against them.

                Because I am the neighbour and it has nothing to do with football, it is to do with anti-social behaviour from neighbours, not one on the street gets on with them.

                Planning has been breached but LA are very slow at doing anything.

                And solicitors cost money

                      If it was up to me I would put up a 5m pole my side of the fence with spikes so to catch and rip their flags, but that may be illegal.

                        I know how to behave, there is actually three sides to every story......
                        I can give a full list of things these anti-social neighbours have done in the last few years.
                        They have already ran a neighbour out of the street with their attitude,

                        So please continue as you do not know anything about the issues.......

                          Best not to get into a war. I think you should see if your local MP can help, it's evident that something is going on, two neighbors on either side of you erecting flags. I don't think we have 2 flags erected in the whole borough (don't know for sure).

                            You say you have notified the LA, but suggest they are dragging their feet.

                            To whom did you report the breach of planning?
                            Was it the planning department, the enforcement officer?
                            Did you get your local councillor involved? the CEO of the council?

                            how long ago did you make that report?
                            Have you made an official complaint about the length of time it is taking to enforce planning law?

                            depending on the answers to the above you could possibly make a complaint to the LGO.


                            Regarding the trespass, if having asked both parties politely to cease the trespass and they have not agreed but continue with their actions, you could
                            apply for a court injunction ordering them to cease.
                            You would need to send them both a signed for letter asking them to cease their trespass.
                            It would need to warn them that if they did not comply you would be applying for an injunction ordering their compliance, and applying for an adverse costs order (so they pay the cost)

                              No war yet (wife keeps me in check), we stay rural with only 35 houses and only two flags,
                              other neighbours have commented and do not like them.

                              Very obvious something going on but could not get any answers from them in the past and now both are not approachable, would say going on for about a year but could actually be longer when I think about other things in the past.

                              MP is an option, and
