Historic Caution on Property from Midland Bank

  • Historic Caution on Property from Midland Bank

    I wonder if somebody can help. My parents are trying to sell their house but a search on the land registry has shown up an old caution from the Midland bank. My Dad thinks it was dealt with but now can't remember and has no paper work dealing with it, the Caution says :

    Under Section B Proprietorship Register

    2 (21.08.1991) CAUTION in favour of Midland Bank PLC of 125 Poultry, London, EC3 and of 1 High Street, Chislehurst, Kent, BR7 5AB

    Now the HSBC took over Midland in 1999 and we are struggling to find anybody there that can help.

    Any advice would be gratefully received.

    Have you tried talking to HSBC?

    Otherwise you could look into doing it yourself - worth a chat with the land registry to check which form as it's a tad over complicated.

    Cancellation of a caution—application by the proprietor etc


    223.—(1) A person may apply to the registrar for the cancellation of a caution if he is—

    (a)the proprietor of the registered estate or a registered charge to which the caution relates, or

    (b)a person who, but for the existence of the caution, would be entitled to be registered as the proprietor of that estate or charge.

    (2) An application for the cancellation of a caution must be in Form CCD.

    (3) Where application is made under this rule, the registrar must give the cautioner notice of the application.

    (4) Following the expiry of the notice period, unless the registrar makes an order under rule 221(4), the registrar must cancel the entry of the caution.

      Thank you Amyethyst. I've just heard that they have managed to sort a meeting at hsbc tomorrow, so I am hoping that can resolve things. However I will also give the land registry a call.
