  • Survey missed asbestos in the house

    Hello.
    about 4 years ago i bought a bungalow which i took mortage for
    mortage lender done a survey for the property unfortunetly they missed asbestos tank and boards which are located somewhere under the roof

    the problem is that im selling the house myself now and i found a buyer who done his own survey and they found told asbestos under the roof
    now the buyer is pulling out from purchese becouse of this asbestos
    He says he used to work with asbestos and he had a cancer caused by it and that he doesnt want to have anything to do with asbestos
    Now since im losing client im also losing alot of time to find a new one and very possibly alot of money becouse of plans i had with the sale
    not to mention i possibly wouldnt buy the property myself if i knew its full of asbestos

    Question is. Can i expect a compensation from company who missed asbestos in their survey?

    Normally the mortgage lender just does a valuation survey and not a full structural or homebuyers survey. Did you have a full survey undertaken before purchase yourself or was it just the mortgage lenders survey ?

      Im not sure.. i think i took extended survey just dont remember. Will have to contact the agency i was buying home from and ask for details. However i spoke to santander survey complain department and asked them for survey report. They admited on the phone that they innded missed it and they made a complain for me. Now i need to wait up to 5 working days for them to call me back

        You cant identify asbestos through a survey alone and you need lab analysis to confirm the presence of asbestos. There are certain materials which are more likely to contain asbestos but only testing can confirm this.

          I take it you did not seek a full survey prior to purchase i.e. in depth survey?
