  • Can anyone help with Without Prejudice?

    Hi there Beagles
    A quick question regarding an ongoing issue with a housing agent and his solicitor.
    Over the last 8 months or so I have been in an exchange with a solicitor representing a housing agent for the flat below mine. The exchange has become increasingly more like harrassment from this gentleman and his most recent email is also replete with out and out lies, clearly are being used as threats. In this example he is claiming to have a ruling on a court case that hasn't even happened yet. However, this latest masterpeiee started with Without Prejudice....
    I looked up the term and it seems that by its inclusion, anything in the letter, including the falsehoods and harrassment would not be admissable in court, if I choose to persue it.
    Is this the case?
    It seems to be a terrible loophole for bullying and harrassing behaviour.

    Without Prejudice is only applicable to a letter if it contains a genuine attempt at settlement. It's not applicable to be used to hide communications of a harrassing nature - so it really depends what the letter says and if it does contain a genuine attempt to settle the issues.

    What's the issue you're dealing with with this housing agent for a neighbours flat ?
