    Hi, I have had an offer accepted on a large end terraced house and the estate agent said that the large side garden is part of the deal. however there is a gate into a back street from this garden which looked like a council gate so i went on the land registry to check the boundaries. it seems the garden has a separate entry on the register. Obviously I don't want to purchase the property without this garden as i want to extend the house. Is my only option to buy the lease? I've never been in this situation before!

      What do the house owners say? They may own & be selling both, never believe an estate agent they have a vested interest in telling you what you want to hear.
      Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

        I didn't actually pay for the info on the land registry so don't know the name as yet. I was just curious and thought I would see what I could find out before we instruct a solicitor. I will be asking the estate agent for further info today. But assuming the land is council owned, where would that leave us?

          seen near here council land never used or grass cut and next door to the area fences it off as theirs and landscape, ???

            And then apply to the land registry for adverse possession after 12 years.

                Thanks for that. The change gratefully noted. I've seen a case recently when there was no registered owner of a piece of land and an application was made for adverse possession. If that is the case then surely, with no proprietor named then the rest of the procedure would be nullified?
