  • Payment of CCJ

    Hi,

Wondering if anyone can shed any light on the 'order of priority' (for want of a better term) of payment off a CCJ?

I recently won a counterclaim and a CCJ was awarded in my favour. The amount consisted of a penalty and costs.

The debtor has attempted a new claim, and has been told by the county court that this claim will be stayed until the costs relating to the first claim are payed.

Can the debtor pick and chose what they pay, ie pay the costs but not the remaining amount? onder if anyone can shed any light on the 'order of priority' (for want of a better term) of payment off a CCJ?

You can apply to the court for the stay to be lifted and make an application for a warrant to
      be handed to a bailff.

Is this 'new claim' the same as the original claim ? ie. based on the same cause of action ?
