Re: How do you take your council to court for everyone

Thankfully, HMCTS have been very helpful and a judge twigged what was going on last year when the "trustee" attempted to seek an order and had it pointed out to them that as there was no BO in existence, they could not have an order and to stop wasting the court's time. I'm just waiting to hear the outcome of a possession application the person I am helping was facing. The claimant was served with a defence and a notice giving them seven days to prove bankruptcy which is what it sounds their grounds for possession centre on and unless they do, the PO will be subject to strike-out. If that happens, any other repossessions will be brought into question and the claimant could be facing serious litigation and investigation as the court can refer the matter to the CPS.

Just an update.... Am a lot further on this but was asked not to disclose whilst its being looked at whislt were in paperwok mode.

If i have to take action, it will be judicial review of the operation of the paperwork proir to judge seeing it for liability orders... Thedre should be an update on this in the next three weeks...

But to answer the question i posed, How do you take your court to court for everyone.

Judicial review ---- it just requires permission and a few qualifying markers. JR is usualy used to check a judges dissisions, but, the circumstances we found, ment that the judges never got the correct information prior to issuing LOs, that why it took some time to understand if JR was the proper route...... Updates in a few weeks......

I didn't pay my £125 costs last year because of this fraud. I was aware before I went to 'court' that these orders were rubbish, and I was even more incensed as the reason why I was there because of the incorrect information they gave me! After I paid what was legally due, on the same email they said btw you owe council tax from 2011. I have come to the conclusion that MY local council will not accept responsibility for their mistakes and will issue court orders at the drop of a hat. When residents have mental breakdowns because of this wickedness who foots the bill?

I have been reading with baited breath and have total and utter respect for you Crazy Council. I have suffered at the hands of Sandwell Council and have been left destitute and homeless and the Magistrates are as corrupt/incompetent as they are, it's disgusting. I love the Law and find it fascinating and 100% believed that if you are innocent the Court will see that (how niave), I was forced to phone the police on a Fraud Investigator (didn't know who he was as he didn't tell me) he was not compus mentis and really frightened me and my daughters leaving me no choice but to ring 999 and because I told the operator and officers that this man was either drunk or high on drugs (he was) he has taken our home, all our belongings etc it's been horrible all to save his 'reputation' . I still can't believe what he has been allowed to do so 'Crazy Council' be careful and all the luck in the world. x
