  • Hit by drunk driver whilst on my car

    Hi everyone..
    I rarely use forum.
    Last months, I had the unfortunate incident of being in a collision with a drunk driver whilst on my car.
    The woman at fault who had been drink driving. I have been suffering serious injury.

    I would just like to ask anyone on here what their thoughts would be on amounts of compensation I could potentially gets.

    Have criminal charges been bought against the driver and was any compensation/damages discussed then?
    Have you discussed your case with a Personal Injury Lawyer ?

      Thanks for reply.

      Yes, I have discussed my case to my solicitors. He says,
      I will be getting somewhere around 7500£. Is it enough for my injuries?

          I broke 4 vertebrae's in my back including a major one, dislocated baby finger, swelling to my knee meanwhile minor whiplash from falling from a height of 10 foot after being projected in the air by the oncoming car.

          Her insurance company offered a low 7,500 but solicitor tells me I can get more than that but wont disclose how much.

            I am no expert but that seems low as the Solicitor is acting for you ask them what the sum of compo might be seems they want a quick result.
            Did the driver face Court?

                  Your solicitor probably can't say how much compensation you are likely to get.
                  If your accident only happened a month ago, don't be in a rush to settle.
                  Back and whiplash injuries are notorious for taking a long time to sort. You may think it is all better now, but they can come back months and even years later to bite.
                  You also need to be aware of the possibility of post traumatic stress disorder surfacing later.

                  I trust your solicitor is also dealing with all the subsidiary losses you will have suffered.

                  It's many years since I dealt with motor claims but for soft tissue back injuries I would have expected five figures and for serious injuries not resulting in paralysis anything up to and beyond six figures. It is impossible to give a figure on the basis of the information submitted, but your solicitor (if he is a personal injury specialist) should have up to date guide figures from the most recent cases.

                  As Amethyst suggested in post 2 you are well advised to contact a specialist Personal Injury Lawyer

                    It is really hard to predict the amount for compensation as it varies from case to case. In most of the cases all the cost of your medical blls, vehicle You could also recover any wages or income that you lost, both past and future, as a result of the incident. In addition you also get compensation for the damage to your vehicle caused by the accused.

                      In my Opinion, your compensation amount should be more than what your solicitor told you. I would say you that there are lots of expert solicitors in the UK. why don't you consult with them? You can get legal advice from them free of charge and you will also come to know how much your compensation amount will be.
