  • BW Legal/Lowels CCJ letter falsely stating a ccj entered against my name on 25/10

    I received a letter regarding a pending ccj. It says it was entered against my name on 25/10/13. I have an email from Money Claim (government website) saying this is not the case as i acknowledged it on 21/10/13 thus i have until 8/11/13 to file a defence. Is this letter illegal?

    Below is the history leading il to this:

    BW Legal the solicitors for Lowels tried a stat demand first. i emailed offering them £1k infull and final settlement and explaining that i was on ESA recovering from a nervous breakdown (my sister has made the money available to me), they wanted £7k which is for an HBOS credit card debt. (They told me they couldn't deal with by email due to Data Protection it had to be by phone, I find this hard to believe. i did not phone but emailed again.) I do not mind paying my debt but don't have the money. i worked in sales and was flush pre having a nervous breakdown.


    I have received a CCJ for £9K+ which is the HBOS debt plus interest. I acknowledged it and have to respond by the 8th of November 2013. I received a letter from BW Legal telling me on the 25th of October 2013 that there was a CCJ entered against me and i had to pay all or make a payment plan. I have an email from MoneyClain online saying this is untrue and i have until the 8th. I have been so ill this weekend thinking that i had messed up only to find out on Monday that i had not. i intend to argue the interest.


    I think this is OUTRAGEOUS that they can write a letter telling me I have had a CCJ entered against me on the 25th of October 2013. I have only recently come off ESA (my own choice), i thought i was going to have a relapse. What can i do? They know that i ill.


    A CCJ will kill my ability to raise credit and i am on a government scheme called NEA starting my own business.


    I have a number of other credit card debts which they are buying up and sending me MANY letters and email (no idea how or where they got the email address as it is not the one i have told to use to communicate). They are making my life hell. I looked into selling my flat but there is a building site next door and the trucks will be parking outside my flat for the next 4 years and the site has damaged my foundation to my property. My flat is now worth less than i paid for it in the height of the boom. i can't rent it either as the vibrations and noise are 8am till 6pm and a generator hums loudly all night... I have tried!


    I am 37 and i can't stop crying. i feel pathetic as i don't know how to deal with this. i feel like i am being bullied.


    I would be grateful if you cannot help me if you can push me towards someone who can, please.

    Sounds like you have a court claim, rather than a CCJ. You can find out if there's a CCJ against you here: http://www.trustonline.org.uk/search-yourself

    Could you scan or take a picture hoto: of the paperwork you have recieved, cover up your personal details and post it up here? :typing:

    You shouldn't let creditors bully you like that! :nono: We are here to help, would be useful if you could start a separate thread about these other debts and tells us the following:
    • Who was the original lender (bank or credit card company)
    • Who is the current account owner (bank or debt purchaser)
    • Who is chasing you
    • What's the outstanding balance on each one of them (approx.)
    • Approx. date when you took out the card
    • Approx. default date
    • Approx. date when last payment was made (in case you made reduced payments after defaulting)

      Hi London Girl,

      Things sound like they are a bit crappy for you at the mo without the added crap BW Legal are putting you through, really try not to worry and remember to take everything BW say with a big pinch of salt.

      Is there any way you can scan / photograph / and upload a copy of this letter or type it out for us (if you upload it blank out all your personal details first)

      So BW Legal issued a Stat Demand against you - you responded to BW Legal by email offering to pay a full and final settlement which they refused. Do you know what happened with the stat demand ? What date was the stat demand served on you originally ?

      You then received court papers around 10th October ? (also from BW Legal?) and have entered an acknowledgement with a view to entering a defence or offer to pay? Have you made a start on that if it has to be in by the 8th ?

      It might be of help if you can upload copies of the front page of the moneyclaim or type out the particulars of claim.

        Being sick nearly dying or dead wont stop them trying to get money they say you owe best to read advice that comes on here answer the questions and someone will be able to help.
        Don't work yourself up into a deep depression keep calm they wont go away until they have no but with help you WILL get through it

          Its understandable that your worried and upset. BUT one of the site owners, Celestine, has a staggering record of success in dealing with BW & Lowells. I know she'll help if she is available. In case she isnt around suggest you contact the SOLICITORS she works for asap. They are www.howlettclarke.co.uk She and another Beagle (Paul) run a dedicated consumer credit team for the firm. Its there to help people in situations just like yours. Theyll tell you quickly if they can help and if there is likley to be any cost to you..............usually NOT I think.

          Chances are Lowell and BW will run a mile if they get a sniff that Howlett Clarke/Kate Briscoe are on your case!!!!

              Hi and welcome to Legal Beagles.

              If the claim is subject to the court receiving your defence and has yet to be heard by the court, then BW Legal and Lowells are, in my view, seriously out of order. Whether this would have an adverse effect on BW Legal/Lowell's case is something I would not like to comment upon. My background is in Criminal Law.

              I will bump this thread so that one of our debt specialists can look in and advise you.

                Sounds to me as if something has crossed here? e.g. Lowells have gone on to request judgement at expiry of the 14 days from service and your AOS wasn't showing up so they assumed a judgement would go through? Or they have just gone ahead and sent the letter before checking altogether?

                Either way, as long as the court has confirmed that the AOS went through in time then should be OK.

                    Morning!

                    I managed to find a friend with a scanner on their phone last night. Today I edited them in Photoshop. I am broke hence I couldn't pay to get them scanned I will however later today have access to a better scanner so can re do them if that is necessary.

                    Below is a copy and pasted version of the email "Money Claim" sent me. I have removed the header as it give away my real name and I wouldn't put it past Lowels and BW Legal monitoring this site to see who is near breaking point.

                        Alas my house was flooded twice with raw sewage last year from a shop next to me (I live on the ground floor) I had all my filing in boxes under my bed and it was destroyed (I had a truck with a long hose sucking it out) I was very organised but it had to be thrown away. All my debts are now handled by debt collection agencies. How do I find out the information I have highlighted above in green? Do I contact HSBC directly or do I speak to Lowels?

                            It seems obvious that Lowlife are playing at Silly Buggers, but it would appear that they've devised some new variations.

                            First of all, why should they seem to offer a discount for prompt settlement after a Statutory Demand had not been set aside in time?

                            Then why should they aver that judgement had been given in their favour for the same alleged debt, when that case was still before the Court?

                            One might suspect that they cannot produce even a reconstituted agreement - and they know they can't - hence their attempts to bounce their victim into paying.

                              The letter of 9th July is a classic:

                              On 17 June 2013 you were served with a Statutory Demand dated 3 June 2013.
                              It may not be illegal but it is certainly suggestive of sharp practice.
