  • allocation questionnaire . sued by CMC .

I'm being sued by a claims management company which I've already filed a defence for .my defence had to being by the end of August ( which it was) since then I've heard nothing except a letter from the company concerned that they were rejecting My part offer. Now my question is this, is this a usual length to wait or(almost 2 months) or have they given up the ghost? Any one with knowledge of timescales would be greatly appreciated thanks.

Hi, welcome to the forum. I thin we'll need a bit more info to be able to help. What was the claim for, who are the Cmc, what was your defence and part offer.

also you titled the thread allocation questionnaire ... have you had one from the court? Also was the claim through the Northampton bulk centre?

Yes, the claim was for non payment of their fees approx £2500, my defence was negligence on their part due to me receiving theoffer for settlement of ppi 10 days after it had expired. I've not had an allocation questionnaire from the courts yet(donethrough money claim online i think) my part offer was for £200 for their workdone which they told me they had rejected (this was early september) I was just wondering if the time scale of 7 weeks was anything unusual for nor receiving an allocation questionnaire? many thanks I'm fairly confident Ive got a case. I sacked them immediately after this and recived a lower offer from the bank in question. They are trying to claim theire fees for theoriginal offe plus interest. many thanks for any input

Sounds good. The best bet is to telephone the court to check all is well, it isn't unusual for it to take a good few weeks between defence being entered and AQ's being dealt with. The case should automatically be transferred to your local court (as you are an individual as defendant) and you will receive notification of this at some point - maybe call your local court to see if they have the case allocated to them as yet.

They did invoice me before they went under . They were part of that pair that got banned by the SRA for ripping off miners' widows I since found out

So just to be clear Keypoint were a solicitors with whom you engaged, they got you compensation and billed you and subsequently went under.

At what point did you receive a deed of assignment (from mysolicitor.com ?) and was the assignment for the debt or the ongoing claim?

In a nutshell yes. I received the deed after the liquidation and the debt sold on top the new company

What was the difference between the original offer and the final settlement?

And which offer was the fee that the disputed debt was based on?
