    Re: Rental Property-Section 21 Notice

I was under the impression once served a S21 endures, however the Landlord does not have to proceed to court for possession. He can elect to leave the tenant in place if he wishes.
I have even heard of Landlords issuing a S21 the day after the signing of the tenancy agreement

Thanks to you all for all your advice.

The local housing are looking into things for me,however I think I'd struggle to get a council property with the high rise in people that need re housing in my area.

As single parent with a child you will go to the top of that list because you are a priority. It's not about the number of people needing housing in your area, it's about your local authority's statutory (i.e. legal) duty to house you. End of

Don't wish to be rude but I do not think you know how social housing lists work ,in this area there are a good few more people some with more than 1 child than houses or properties available and this county must be one of the richest in the country after all the PM lives not 15 miles from me

The case of Superstrike Ltd vs Marino Roderigues may have changed all that. That Supreme Court ruling in June decided that a rolling contract was in fact a *new tenancy*.

If a Landlord issues a section 21 Notice at the start of the AST (I always do that) then it endures until the fixed period ends (as far as I'm aware) and not beyond. Courts regularly reject any suggestion to the contrary.

Are you sure you don't wish to be rude

I may not know how social housing lists work (actually you're wrong on that assumption) but I do know the law which is what matters to the OP right now.

Do you really live only 15 miles from David Cameron? I'm impressed :hail:

Certainly in my area it is all about priority. Generally single people get low priority and there is also a lack of 1 bed accom. If you have young children then you get much higher priority. I know of one instance (Don't we planB) where a couple with a baby got evicted for non payment of rent and very quickly got rehoused (first in a B&B..well Travel lodge I believe and then in a home) This was in one of the poorest counties in the country

If I could get past the policeman outside, why don't you look for him hes in his local town quite often and give him the message I think someone may be getting the poor OPs hopes up to much knowing the law ads the reality of waiting lists are 2 separate things .

If you are referring to me as that "someone" then you are quite wrong. It's not about hopes it's about the OP's statutory rights :beagle:

^^^^ Yes we do Jon. And Kilasuit and his young son are enjoying life in their new home thanks to him fighting for his legal rights. I confess I may have had a little something to do with that happy ending
