  • Adding to defence in county court

    After depositing my defence at the small claims court something as come to my attention that I would like to add to it.

    Just wondered if this is possible after the time limits for putting defence in have passed and is there a form or procedure for doing it.

    You would need to ask for permission to amend your defence with an application form N244.

    It will cost a fee (detailed on Her Majesty's Courts Service - Home
    ) and you would send your amended defence with the amendments in red ink with the application.

    I don't think there is a specific time limit on doing this, though obviously it may put back any hearings set.

    It would also be 'polite' to send a copy of the amended defence to the claimants and let them know you have applied to amend.

    If they dispute the amendments they could ask for a hearing of the application.
