  • A Certain Delivery Company Keep Losing My Parcels

And I'm getting fed up with it.
3 parcels totalling nearly £200 now gone awol after investigation after they were shown as collected and havent moved from their delivery hub. I sell one of my late mothers items worth between £95 - £150 to somebody on Ebay for £95 + postage. Sent tracked and signed.
The parcel tracking stops midway and 15 days later still showing as 'active' and is now reported as 'lost'
In a nutshell I've sold somebody an item worth £95 minimum to me to a lady that has paid £95 for it and hasn't received it. The courier will at sometime refund me the £95 but I have to give that to the buyer leaving me with nothing.
So basically I have had my item 'stolen in my book and end up with nothing. Add this to two other occasions within the last month where the same thing has happened and I am getting fed up with it.
Question: I want to take this to a small claims court for the original cost of all three items because I dont want them to keep getting away with it? Anybody done this before? Thankyou.

If the lady paid you £95 and you receive £95 compensation from the courier then you have received £190 in total. You refund the lady her £95 and you’re left with £95. No loss?

So you pay me £20 000 for a car which i say I'll get delivered to you, I've got your money. The car goes missing mid delivery never to be seen again the insurance pays out the £20 000 which i give to you so I end up with nothing and thats ok?

You see what I want is the original value of the parcel sent and lost.

So send them a letter explaining what I intend to do explaining that unless they refund me the original value of my items before I put them up for sale on eBay I will carry this forward?
            Thankyou Atticus

so what happened to the £20,000 I paid you in the beginning?
and your contract with courier will only cover you for the insured value

              Change courier?

If I paid you £20,000 and you receive £20,000 from the insurance company then you have received £40,000 in total. You refund me my £20,000 and you’re left with £20,000. No loss?

                    ^^^^^^^ This!

I think the OP may not be telling the whole story...

(I suspect it wasn't insured for its value).
