  • Private Hire Driver Application\Council Hearing

    Hello,

Please take the time and read my situation.

On the date of 26/06/2018 I applied for taxi a taxi license at the council of Wolverhampton, in my ignorance I forgot to check the taxi guidelines which states that I need to inform them about the 6 points on my drivers license. A week ago I received an email saying that a mini panel hiring will take place which I need to attend because points were found doing a DLA/DBS check on my name and it's a high risk. Can I please be guided on how should i proceed with this situation! Thank you in advance!

    Dear Mr

I refer to your recent application to Licensing Services for a Private Hire Vehicle driver’s licence.

As a result of your criminal/motoring conviction(s) on the attached report, it will be necessary for you to be interviewed by a Section Leader.

You will need to book a time and date to suit you within the next 3 months. Failure to book an appointment or not attending a booked appointment may result in the hearing taking place and a decision made in your absence.

You can book an appointment by clicking

You may, if you wish, be accompanied at the interview by your solicitor or some other person to speak on your behalf.

If you do not wish to attend a hearing, the Hearing can take place in your absence however you will not be able to provide any mitigation and this will adversely affect your case. If you do not wish to attend, please reply to this email stating:

I am not attending a Hearing to provide any mitigation or reason why I should be granted a Private Hire Driver Licence, contrary to the Guidelines Relating To Relevance Of Convictions And Breaches Of Licence Conditions, please conduct this Hearing in my absence.

    Kind regards,

    Senior Licensing Officer

The points were awarded against you while operating a licenced taxi ? ( breach of requirements consol mobile phone ? - it's a bit tricky to read - was that earlier this year ?)

I'm afraid I can't help - as I know nothing about licensing- someone else on here will hopefully pop in with thoughts.

If you want professional assistance I believe Joanna Connelly solicitors deals with a lot of taxi licencing issues and offers fixed fees although she is in the Liverpool area - just look her up if you want a chat with a specialist in this area.

Any support I provide is offered without liability, if you are unsure please seek professional legal guidance.

CU80 Breach of requirements as to control of the vehicle, such as using a mobile phone
      Wolverhampton's guidelines:
A major traffic offence is a road traffic offence (other than for totting and drink driving) that can result in four or more penalty points and/or a period of disqualification and/or imprisonment

First offence – will normally revoke or refuse to renew. A new licence will not normally be granted for 5 years following the expiration of the disqualification period or if not disqualified 5 years from the date of conviction, caution or in the absence of these the date of offence or relevant incident.

You will need some good mitigating arguments to persuade the licensing authority to grant you a licence

Thank you for your replies. This is unfair, I've waited about 6 months to get all the paperwork done and I am getting punished 2 times for the same thing, Can someone please tell me, if a pay a solicitor (what expenses will there be ?), will I get the license? thak you!
