In other words they have breached the agreement by not keeping to a time schedule which was of the essence.
That failure has deprived dido of the opportunity to obtain a benefit, and is surely actionable.
In this case the loss is quantifiable,and therefore perhaps loss of expectation rather than loss of chance.
However as previously suggested, court action is the last resort!
