Threatening to send Non consensual video.

Hi, not sure where this thread is supposed to be.
someone has a Non consensual video of myself and someone, not my wife, not proud of it. But they are threatening to send it to my wife. Can they legally just send it too her. I was sure itd be a crime sending explicit material privately as well as posting it online. It's hard trying to find out where I stand on this.

Oh dear. Okay firstly is this an online activity thing ( like webcam recording ) and you're being threatened by, basically, a scammer... or is it a real world thing ( like a work colleague / friend threatening you after capturing the video ). Are they asking for money in return for not disclosing the video ? or is it the other party involved making the threat?

Thanks for reply. It's a little tricky, the person who secretly filmed his wife and myself (so he knew, he wasn't being duped he was aware and ok with this).
now they have split up after a very long and abusive,controlling and manipulative relationship. He is not happy and wants my wife to know. No blackmail mentioned at all. I just want to know what I can or can't do before I confront him. He believes apparently he can send it as it's posted privately.

Okay, when you say 'posted privately' what do you mean? is it already available online but in a private area on a website ? or does he hold a copy offline and is threatening to put it online and, say, send a password to your wife to view it?
It sounds like this will fall under Revenge Porn laws so would likely be classed as a criminal offence. There is also the issue it was recorded without your consent which is also a criminal offence I believe - des8 ?

Revenge porn: The law

Across England, Wales and Scotland, revenge porn is a specific criminal offence. ( Criminal Justice and Courts Act 2015. )

It's described as "the sharing of private, sexual materials, either photos or videos, of another person without their consent and with the purpose of causing embarrassment or distress".

The offence covers photos or videos showing people engaged in sexual activity which would not usually be done in public, or with their genitals, buttocks or breasts exposed or covered only with underwear.

It includes sharing the material as well as posting it online.

In England and Wales, the maximum punishment is two years in prison - in Scotland, it's five years.

Thanks so much for your help. I believe he would just send via messenger via FB. Apparently he has many videos of wife who didn't have a choice because of the controlling husband. And posts them on a site. Since their split she is obviously very worried where these video are being posted. And that he has all these even after separation.

She sounds like she may have been a victim of abuse so her priority needs to be for her own safety and security.

It seems likely one or both of you will need to involve the police. It also seems likely that you are going to have to speak with your wife about it.
