  • Won non-molestation & costs - non-payment

    Dear all

Perhaps I will summarise a terrible 2 with my ex partner who was then only my wife of 17 days.

She pursued a non molestation order after I left her that has been thrown out as well as awarded costs (going into 5 figures).
It has been 6 weeks, no appeal.
What options are there to pursue this?
Given it is contempt of court.
She is a practising medical doctor, so has the financial means.

    Thank you

    Yours sincerely,

    Sam

    Hi Sam

You would need to make an application to the court for enforcement of the Judgement you have got. You can do this one of three ways:
    1. Warrant of Control to allow the bailiffs to recover the money or goods to the value of the judgement to be sold at auction,
    2. Escalating the Judgement to High Court for enforcement via a Writ of Control to command High Court Enforcement Officers to recover the money or goods to the value of the judgement to be sold at auction
    3. Attachment of Earnings Order.
Each carries a fee that is added to the amount of the Judgement, but 2 is the cheapest at £60.
