  • Getting off the mortgage with my ex

    Hi guys, I’m hoping someone can help me or at least point me in the right direction. My partner and I spit up about 2 years ago and we have a child together who is 3 and a half years old. I have a mortgage with my ex and she has been living in the house since she split as she has 2 other children too and I felt she needed the roof over her head more than I did. I have now met someone else and we want to get a house together however at the moment I am unable to do this as I still have the mortgage with my ex. I have spoken to her about getting me off it and she doesn’t want to move so the only option is to buy me out, however she can’t afford the mortgage for the current house on her own. I would never leave her homeless and have given her various options such as selling the house and downsizing but she doesn’t want to know. I understand she has 3 children and downsizing isn’t ideal but only one of them is mine so I don’t feel it’s fair that I should be paying for her to live in a four bedroom house while I am having to live back with my parents, unable to move on with my life as I can’t afford a house of my own. I have tried to explain this for her and she just tells me not to push her as she is legally entitled to stay in the house until our child is 18 and she will quite happily do that – Is this true? I am just wondering what rights I have (if any) and if there is any way I can force her to sell/find a solution to get me off the mortgage. This is all new to me and I don’t have a clue how it works and where to go from here with it – please help!

    Do you want to just come off the mortgage or release funds from the house?
    Who is paying the mortgage?

      I want to release the funds from the house as i have put alot of money into it and it was originally mine before she moved in with me and we took the mortgage out together. I know it sounds petty but i really dont want to walk away with nothing becasue everything i have has been put into that house and i dont want to be 35 and have nothing to show for it! Before she got declined for the mortgage on her own we agreed a sum which was far less than what my half is worth but i just wanted to be done with it, i would still be happy to accept that but she seems to be getting progressively unreasonable as time goes on. I would be happy to get the money at a later date when things are a bit more settled (if something can drawn up for that) - My main concern at this moment in time is to get my name off that mortgage so i can get a new one for a house i actually live in. We both pay towards the mortgage - I pay money into her account both for child maintenece and my share in the mortgage
