  • Separation & Joint Mortgage?

    What happens when a couple is not married but have a joint mortgage? Who is entitled to what? If one person moves out willingly do they lose rights?

        So in answer to your original question no, the person leaving the property doesn’t forfeit all their rights.

        Yoi are joint mortgagees and therefore both own half the property, so would be entitled to half the equity as a starting point. Other factors such as who put the deposit down, what proportion of contribution each party has made to the repayments and all sorts of other things can adjust the percentage.
